Dog Chasing Cat Ends With Domestic Dispute, Woman Jailed

An incident that begin with a dog chasing a cat ended with a fight, a Molino woman under a horse, then barricaded in a house and then pepper sprayed at the jail.

Kelly Nichole Herzberg, 28, of Highway 196,  was charged with felony count of aggravated battery with a deadly weapon and a misdemeanor count of battery.

The Escambia County Sheriff’s Office responded to a home in the 1100 block of Highway 196 Saturday night in reference to a disturbance.  Herzberg’s mother said her daughter’s dog was off its leash, chasing the family cat. The mom looked for the cat in the barn, where she found Herzberg in a stall with a horse. The mom told the daughter to exit the horse’s stall for her safety.

At that point, according to the Sheriff’s Office report, Herzberg said “no way” and proceeded to get underneath the horse. When mom entered the horse stall, Herzberg allegedly pushed her. When the 28-year old’s father entered the barn, Herzberg began yelling that “the horses were hers and the barn also belonged to her and that everyone else was going to die tonight”, according to the arrest report.

Herzberg then, according to the report, left the barn, throwing rocks at the father. He was struck on his chest and side. Herzberg then ran into the house, locking the family outside.

The father told deputies that Herzberg stated that “she had a bullet for him”, and a 22-year old sister told deputies that Herzberg also said “I’m going to get half your will. You’re all going to die tonight”.

Herzberg refused to open the door for Deputy Jason Mann or Sgt. Jay Camac when they arrived at the scene. She told them that “the FBI had been notified of the situation and that the house belonged to her, not her father”.

As Mann and Camac waited for backup to arrive in order to make a forceable entry into the house, the younger sister made contact with Herzberg by phone. Herzberg agreed to allow the younger sister to enter the house through the garage. She threatened to kill the sister if she allowed deputies to enter the garage, the report states.

When Herzberg unlocked the garage door, she was taken into custody by deputies.

At the Escambia County Jail, Herzberg became violent toward detention deputies and was pepper-sprayed, according to the ECSO report.

Herzberg remained in county jail Monday night on $3,500 bond.

    I considered that. But we typically don’t identify victims by name. And the report contains K’s name, exact address, employer, work and school history, height, weight, etc (as does every public record report, except on minors). I don’t think that would serve K very well.

    Don’t blame william.
    He always gets his facts straight to the best of his ability and that
    is by going by public info.

    Once you call the law or someone else does…. it’s out of your hands.

    One of my uncles got into trouble once and it was all over town.
    No one knew he was decorated war hero from vietnam who recieved
    a brain injury during the service of his country.

    My mother never said a word and it was her favorite little brother.
    She said, “Thats ok girls it looks bad and they don;t know him like we do,
    and we have too much to do to help him to be concerned about
    what other may think.:

    When things hit the news and it’s personnal it’s hard to take right
    or wrong.
    Try throwing yourself into what your girl needs now and get off the
    computer news.
    Thats my best advice

    We would certainly want to correct any mistakes, and I emailed you asking to point out which half of the story is wrong.. I’ve reviewed the story again and found nothing wrong compared to the report. It’s a fairly lengthy report detailing the events, and it does become very difficult to follow which person is doing/saying what. Please detail your concerns to news@northescambia.com

    I understand that, however if you would have read the report more thoroughly you would have gotten your facts straight and written a truthful article. This is not what really happened. How would you feel if this happened to you and I wrote about it and was wrong in how I explained as to what happened? You weren’t there, this article is wrong.

    Unfortunately, your personal lives become public when the Sheriff’s Office becomes involved. It’s all public record.

    For one this article is poorly written and more than half of it is not true. This is not what really happened. It upsets me that most people are commenting on something they know nothing about. There is much more to life than to be sticking your nose into someone else’s business and making false accusations. This is not the outcome we wanted at all. We are highly upset this website decided to write about our personal lives without consent, and so poorly written as I said before. Their numerous inaccuracies and blatant omissions about what happened are egregious at best and criminal at worst.

    To anonymous: Just giving an example of what can constitute assault…..which can also include spitting on a person….I looked it up in my Funk & Wagnall…..
    In some US jurisdictions assault may refer only to the threat of violence….

    I doubt very much if these parents just called the police for no good reason.
    I’m sure they know more about this girl and the situation than you do.

    This girl is 28 not 12.
    Cool down when they are threatening the lives of every one is not an
    option, and she was agitated under neath of a hors so it became a
    matter of safety.

    Even at the police station she had to be pepper sprayed.
    Obviously she is delusional from drugs or mental problems.
    They were unable to control her and they called who they were
    suppose to before this situation escalated.

    I don’t think the first choice of any parent has ever been to just
    pick up the phone and call the law.

    I hope what ever this problem was this young girl gets the help
    she needs and the whole family gets counseling and can come
    together as a family should.

    For me the best comment is the one who says that she should have been left alone to cool down. It seems that she was depressed and upset before the incident. She was asked to do something and disagreed. Then she was forced to do it. That caused her to break and live near the edge. She probably is on the edge, having difficulty coping. Provide her with support. The father can say that he won’t be a witness as could the other family members. That would result in the case being abandoned through lack of evidence.

    Then more support understanding and gentleness to find out what is upsetting this person. That must be more sensible than calling the police. Don’t get involved with the police unless you really have to.

    If your child is 28 and out of control and threatening everyone’s life
    then it’s time that you call the police because obviously this isn’t
    a baby anymore and you can’t control her violence.

    This child shouldn’t even have been living at home.
    She should have had a job and lived somewhere else and
    learned to budget and pay bills, cook and clean, run errands
    and have home of her own, maybe then she wouldn’t be thinking
    everything mom and dad has belongs to her.

    Of course if she is mentally ill that would explain everything including
    living with mommy and daddy at 28 years of age.

    If this is a mental problem and not a spoil druggie problem then
    my heart goes out to you everyone involved.
    I hope everything is resolved and this poor girl gets the very best
    of professional help.

    In reference to noh8ers: The point is to get them the help they need. You cannot allow someone that is threatening the lives of your family (no matter who they are) to continue to behave like that. THAT PERSON NEEDS HELP! They don’t just need to be left alone to calm down; the girl was threatening to kill them for god’s sake!

    That’s all nice and good to make the decision to let your adult child do what they want, regardless of whether they are breaking the law, but, WHAT ABOUT THE SAFETY OF YOUR OTHER CHILD? How would you feel if you decided to walk away (and you would have to “walk” away because the keys to the car are probably locked in the house) and let the girl cool off; but that instead of cooling off, she stews and gets more upset and you then come home and find that she has killed your other child?

    No, assault is when she “threatened” to kill everyone. Battery is when she threw the rocks.

    So if you knew your child intended to kill all of us and our children and the only way to stop her were to call law enforcement, you would not place that call, you would not stop her if it might result in her arrest?

    Interesting. It makes the girl look relatively sane.

    Praying for strength for the family and friends of this young lady! The only thing I have to say is that I think she would have benefitted from a “Baker Act” more than a “felony and misdemeanor charge” and “jail”. It is apparent there is some mental imbalance going on and she needs assistance. Best of luck to everyone involved!

    A tradgedy for many families who love this young lady. Kelly has always been a bright, vibrant, talented, sweet person. Anyone who knows her will attest to this. We can not comprehend today the illness that has taken over our dear Kelly and we, as a family, are determined to revive that delicate balance in her life. May God watch over her during this very difficult time.

    I don’t think there is anything that my child could do that would make me call the law and get them arrested…..SORRY IF YOU ALL DON’T AGREE……I also know that when someone is irate, upset, etc. ..don’t keep it going….walk away and let them cool off……..I have had experience with bipolar family member, and it is so much easier if you don’t further agitate them, or try to argue with them……after all what is the point?

    This young lady is a beautiful person, I personal know her and her family, I am a close friend of this family ! Kelly is having some problems we are trying to get a grasp on. This has come on very suddenly and we are terrified for her. She indeed will receive the help she needs. We just hope that it is not something more serious than a disorder. As far as Kelly and her parents, she has and will continue to have a very close relationship with them. This is a good family that has come into parts unknown to them. Please be kind with your comments. As this could happen to any family if it has happened to theirs.

    Throwing even a cup of water on someone intentionally is considered assault.

    Whoa…I’m not talking about the horse. Had to read this twice to understand it better. Too many cooks in the kitchen. The 28 year old, Kelly, must have personal issues, she doesn’t get along with the father, she dislikes the mother and doesn’t want to be told what to do. The mother was conerned for her safety and the father seems to freak the 28 year old out for some reason. Her photo and expression shows a lost, tired soul. Hopfully, she’ll get the help she needs…not to mention the entire family. Talk about disfunctional – in a bad and hurtful way!

    P.S. Dogs naturally chase cats. It’s what cats and dogs do…families working together for peace, happiness, and unity is more difficult to manage. Call in the FBI? More going on regarding this chase…

    First, no one should assume drugs are the cause here. Without doing an assessment on this young lady there is no way of knowing her mental stability. Her erratic behavior would suggest there are some psychological stressors in play here. I hope the county assesses this woman and gets her the help she needs. Sadly, it is not uncommon for agencies to withhold or improperly assess or fail to provide necessary care for individuals. I hope this is not a case where she is just keep in lock up waiting for the problem to go away on its own.

    Some people will kill you about their animals. My neighbor beat up on the animal control man that was picking up a stray dog. The dog was terrorizing the neighbor hood and when they came to get it after a complaint the neighbor went wild on him. It was hillarious.
