State, Federal Raid At Jay Medical Clinic; 2 Doctors Surrender DEA Licenses

July 29, 2011

(Updated 9 a.m.) A Jay medical practice is the focus of a federal and state investigation involving several agencies, and two physicians have surrendered their license to prescribe narcotics.

The FBI, federal Drug Enforcement Agency, the Attorney General’s Office, the Florida Department of Health and Florida Department of Law Enforcement spent hours inside the Jay Medical Clinic Thursday as Florida Highway Patrol troopers stood guard outside the complex, which is located next to Jay Hospital. Federal and state agents could be seen inside the building, looking through patient files and other records.

Several items were removed from the doctors’ offices, including computer hard drives and many patient records from Dr. C. David Smith and his son Dr. J. S. Michael Smith. Both doctors were forced to surrender their DEA licenses to write prescriptions for narcotics.

The other two physicians in the practice, Dr. Marian B. Stewart and Dr. Jeffery S. Kelley still hold their DEA licenses and are able to issue all prescriptions, including narcotics.

There were no immediate arrests. The U.S. Attorney’s Office, the Florida Department of Law Enforcement and the Florida Department of Law Enforcement would not comment on the raid on Thursday.

For more photos, including photos from inside the building, click here.

Patients streamed into the parking lot throughout the day Thursday, turned away by the FHP trooper at the door. Many seemed bewildered, unable to comprehend what was taking place inside their doctor’s office.

“I need to see Dr. Smith,” a patient that declined to give his name said. “I need my medicine. He was suppose to give me some samples. I can’t afford to go to the emergency room; I don’t have insurance.”

“This is surprising to me,” Joanne Harrison, a patient of Dr. David Smith, said. “I like doctor Smith; he’s a good doctor.”

“The FBI served Jay Hospital with two subpoenas for records of two independent physicians who are on the medical staff,” said Liz Adams, spokesperson for Baptist Hospital, which operates Jay Hospital, located next to the Jay Medical Center.  She said Jay Hospital is not the target of the investigation, and the hospital continues to operate with business as usual.

She declined to name the two physicians listed on the subpoenas served on Baptist, other than to say they were independent doctors that are on the medical staff at Jay Hospital.

“We do not know a whole lot of what is going on. FBI agent Victoria Harker has informed me that the Pediatric department of Jay Medical is not involved,” Dr. Marion Stewart, a pediatrician  located in the complex, said Thursday afternoon. Stewart said her office will be open as usualFriday and encouraged her patients to contact the office to reschedule appointments.

“Unfortunately, because they are still in the office, we cannot see patients today. We regret that we cannot contact the families that have appointments today. We will work overtime as needed tomorrow and next week to see these patients,” Stewart said Thursday.

The Jay Medical Clinic is operated by Dr. C. David Smith, a family practitioner. Others in the clinic include Smith’s son,  Dr. J. S. Michael Smith, also a family practitioner; Dr. Marian B. Stewart, a pediatrician; Dr. Jeffery S. Kelley, an internist; and Twyla H. Cotton, a nurse  practitioner.

They Jay Medical Complex also houses the Jay Vision Center and Jay Pharmacy. Both of those businesses remained open on Thursday.

Yes she was hooked to the meds but not till he started handed them out and giving her different things every month and didnt fix her made it worse you dont give someone 120 lortabs who has liver problems and dont have enough room to list the rest. My mom never took meds till she started seeing him.

I was under David’s care for about 26 years and it pains me to write this but I feel I must. I recently went and saw David (after the raid) for a follow up. When I finally saw him (about 4.5 hours after I signed in), he appeared like he was in “another world.” I know that he is under tremendous pressure for what has transpired BUT he got himself into this bind. I tried sporadically for years to get off tranxene (prescribed for anxiety back 20 plus years.) He would often say no, your body is just tuned too high. I NEVER bought that line. Now, that the raid has occurred, myself, along, I’m sure with many others are in a hell of a fix because of his “not effectively listening” to his patients. I will get off this junk but it will not be under the care of David. It breaks my heart but I’m going to have to sever my ties. Exoneration: I hope David and son gets their DEA liscences back but they damn sure better be careful but I’m moving on to some 21st century care and to a doctor that will “listen” to me.

This will answer ALL questions. House Bill 7095 The bill changes the regulation of activities by physicians, pain management clinics, pharmacies, and wholesale drug distributors, on July 1, 2011: Practitioners, generally, will no longer be authorized to dispense Schedule 2 or Schedule 3 controlled substances. A few exceptions are provided: 1. Complimentary or sample controlled substances 2. In the healthcare system of the Dept. of Corrections 3. In connection with specified surgical procedures in certain time frames 4.In approved clinical trials. 5. Methadone in a licensed treatment program. 6. For Hospice patients Any controlled substance inventory that was acquired for dispensing that is still in the possession of a practitioner who will no longer be authorized to dispense controlled substances must be disposed of by July 1, 2100.http://doh.state.fl.us/mqa/HB7095.html” target=”_blank” rel=”nofollow”> http://doh.state.fl.us/mqa/HB7095.html This is the NEW LAW. People in REAL PAIN need to contact our state representatives!

  6. Sick & Tired Of Pain on August 2nd, 2011 10:26 pm

There are 3 groups of people 1.Well folks. 2. Druggies. 3. Sick & Hurting people like me. If you are in the 3rd group, you & I are in BIG trouble! Group 1 & 2 are OK. They either do not hurt or have 24hr pain, or they can buy illegal drugs. If you are like me in group #3, it is hard to get out of bed. you take 2-3 pills a day to be able to work or just to function. We are hard-working, honest, loyal people. Some of us can spell well, some can’t. But, we are in PAIN! They have made a LAW that limits the # of people who are to get pain medicine. Will that last person be you or me? We used to have THE RIGHT to be PAIN FREE. WHAT HAPPENED? WHO HAS MADE THIS LAW? If you are like me, we will be hurting again really badly, some may die as a result of drug withdrawal! IS IT GOING TO BE YOU OR ME? Some may not want to live again because the pain is just too much! Is it YOU or ME? Where did our FREEDOM go?

OK. That Lizard guy makes very little sense.

However, on the little “it’s up to you not to be a junkie”.

Yeah, OK, it is. But what happens when someone DOES turn into a junkie? Shouldn’t the good doc STOP prescribing what you’re addicted to??? Rather than keep on prescribing it for years, until you OD on it?

I am a BIG believer in PERSONAL RESPONSIBILITY. But when it comes to drugs, SOMEBODY has to be supplying them. Sure, if the good doc stops prescribing their drugs, they just go someplace else and get them. So, that’s why he keeps handing out narcotic candy? Doesn’t seem like a very educated reason.

  9. Atmore G on August 2nd, 2011 9:28 am

The way I see it is that there are two certainties.. [1] There will be many of Dr. Smith’s patients that have a legitimate need for pain medication (i.e. cancer patients, or patients who have had unsuccessful spinal surgery etc.) that will have to find another doctor to prescribe their medication.. This may be hard to do, as many of our area doctors are not accepting new patients.. [2] Those who may be abusing drugs and were enabled by Dr. Smith (whether he knew he was enabling them or not) will likely be trying to get narcotics any way they can.. This is NOT A GOOD SITUATION, and there will be no easy solution to this problem..

  10. Patient of Dr David Smith on August 2nd, 2011 4:36 am

I would also like to point out that when certain members of my extended family were abusing their medications and I spoke with Dr Smith about it, he refused to prescribe any more narcotics to them. They got angry and switched doctors. They just found another one to give them the same things and quickly too. They didn’t miss a single day of medicine.

For those of you who keep saying that you can spot the ones who are taking narcotics, the only ones you are able to spot are the ones who want them to get high. Those of us who NEED them to function…you’d never be able to tell. When we appear “normal” to you, that’s when we’re taking our meds. When we appear to be acting “doped up”, that’s when we don’t have them.

I’ve been told many times that I “look perfectly fine” so there must not be anything wrong with me. Looks are very deceiving. I never realized that you had to look a certain way in order to be in anything other than perfect health.

I’m surprised at how many people there are who seem to think they are able to diagnose others medical conditions who have never been to medical school and have no degree. You base your opinions on appearances and a very small amount of knowledge. Doctors know so much more than even our friends sometimes. I know Dr Smith does about me. Hell, he’s the only one who knows that I’m terminally ill. I haven’t told my family. What would be the point? It would only make them sad and to start counting the days. I don’t want to live that way. Thanks to Dr Smith, I am able to live a semi-normal life for as long as I possibly can. Without my medications, my situation would be pretty obvious. I owe him my life.

When someone keeps putting them in your hand when they know they will eat them they should be held to the same standerd as the bartender that keeps giving drinks when he knows they have had enough and get in his car and kills someone.

  16. doofus on August 1st, 2011 1:50 pm

I can’t believe some of the apathy towards drug use being posted. Let them do what they want??? They are adults??? Please give me a break.

Addicts hurts themselves and others daily. Financially, mentally, and physically. On the job, on the road, in the home it goes on and on. People that are high all the time do stupid stuff, and stupid stuff can and will get people hurt.

Then there’s the micro economy that these addicts have made. Tax free mind you! If you have 3 docs writing you prescriptions for 90, 120, or more lortab a month, that’s a lot of cash on the street. Heck, why work… live off what you sell and a welfare check.

People stealing to get money to buy pills, raiding abandoned houses, community centers, ad naseum, to sell scrap to buy pills. Selling their bodies to buy pills. It’s happening people, open your eyes.

  17. A Friend on August 1st, 2011 1:28 pm

My grandmother used to go to numerous doctors all around the tricity are and around atmore, etc. She used different pharmacies, too. She paid her prescriptions by cash, not by insurance. She got pain meds and sleeping meds and no telling what else from each of these drs/pharmacies. None of the doctors/pharmacies new of the other ones. We only found out because she went into the hospital in Mobile to have surgery and was supposed to be NPO. She almost died on the operating table because of the anesthesia IN ADDITION to all the pain/sleeping meds she had TAKEN AT THE HOSPITAL!!! She had them in her suitcase! I know Dr. Smith and he is my doctor. He is a good caring doctor and person. It occurs to me maybe he knows a lot of other people like my grandmother and feels like if he can at least keep them coming to him he can hopefully monitor them as best he can. Prevent them from getting them at numerous other places. She was in her 80s!! If people want these drugs, they can get them ANYWHERE! Even if Dr. David Smith never existed. Maybe he’s trying to at least keep an eye on these people and keep them all in one place and watch them as closely as possible. Because if he doesn’t provide it for them, someone will. Possibly someone on the street.

Give the people what they want (adults) – remember PROHIBITION – people will find a way to get whatever they want sooner or later, legal or illegal. I recall a quote from one of our countries forefathers……..Any people what would give up LIBERTY for a little temporary safety deserves NEITHER liberty nor safety…..BEN FRANKLIN.

  20. Common Sense is Dead on August 1st, 2011 9:01 am

    @Patient of Dr David Smith

Where did I say anything about convictions?? I did not. I simply said they have been watching him for years. They don’t just up and decide one day “let’s go raid Dr Smith’s office”. I never said they would convict him, but I did say I BELIEVE they will.

I don’t know what to tell you about the prescription call-in’s. That’s what I’ve been told. I’ve sat and watched someone do it on their telephone. I know it’s happening. I can tell you there’s whining and begging involved, at least the people I have witnessed doing it.

I’m real sorry to have to burst your bubble, but once again, if someone has been on lortab (or whatever narcotic) for YEARS and the good Doc keeps prescribing LORTAB to the SAME person for YEARS, I have to call that Doctor a PILL PUSHER.
That doctor KNOWS those people are addicted to narcotics because he sees them, at least occasionally, and like someone mentioned, if I can pick out a drug addict, I’m pretty sure the good Doc would be able to.

I don’t know why you people keep saying it’s not the doctor’s fault, that each patient should take the meds according to doc’s instructions. Really? You 200th prescription of lortab? Instructions go out the window when you’re an addict.

  21. blue on August 1st, 2011 7:53 am

I had heard one of my friends mom call in and just have to go get her scrip so it does happen. No visit She would have too every once in a while but usually it was to up her dosage or change to another.

  22. blue on August 1st, 2011 7:49 am

Also the comment about pain managment giving out stronger narcotics then what is stronger than the one I see coming out of his office because I can name some of the strongest narcotics on the market and several people that get them.

  23. blue on August 1st, 2011 7:44 am

Also comparisions to beer and other things is good and all if narcotics were just given out by store not by trained professionals and there are people that anyone without a high school diploma and see they dont need pills but they still get plenty.

  24. blue on August 1st, 2011 7:41 am

This is funny alot of people in this town must like playing like an ostrich and burrying your heads in the sand.I cant go anywhere in this town without seeing people that dont need pills that take too many because they are prescribed too many and ones that should not be prescribed together so if ignorance is bliss for you good but its not for me.

  25. missysmom on August 1st, 2011 4:34 am

Would like to see the “patients” arrested that took advantage of good hearted Dr’s. That would be the ones selling the prescribed drugs-and put away for a very, very long time. No sympathy for the black market drug-user/pill-pusher.

  26. Ashley A on August 1st, 2011 1:20 am

@ whoever said rehabs won’t take people without insurance
There is a rehab in Brewton that will take anyone regardless of whether you have insurance or not New Beginnings Restoration Center. I went there and so did my fiancé it’s a great place however neither one of us woke up and said today’s the day I’m going to stop using. My fiancé would actually call and see who was on call at Jay Hospital just so he could go and see Dr. Smith and get more dope. Call me whatever you want call him whatever you want it really doesn’t matter. But when you go see the same doctor 5 or 6 times for the same tooth ache he shouldn’t kept giving you pills he should of said go see a denist theres nothing I can do for you. Everyone talking about addicts and junkies should take responsibility we do. But as addicts we don’t see we have a problem and we dang sure didn’t chose to be and addict. Luckily someone in the world cared enough to help us regardless of whether we had insurance not just keep prescribing pain medication for the same thing. As a recovering addict I know plenty of addicts who use this doctor for their fix it’s easier to get him to write the script then it is to get them off the streets. Also for anyone who’s needing a rehab besides New Beginnings there is Misson of Hope in Mobile
it’s free. And everyones talking now these elderly people are going to have to drive to Pensacola there’s a Medical Center in Flomaton and Brewton as long as your not just looking for a fix they can help you. & if your not using these Dr.’s as a pill supplier you should have not problem with them not being able to prescribe narcotic. It’s quite odd how even though it doesn’t say the doctor ’s are under investigation for over prescribing pain medication or narcotics but everyone knew. & for everyone talking about addicts do you know how many people get addicted to prescription medication because of a doctor? Even if you don’t abuse it you can become addicted. That’s why after you’ve been on a certain thing for so long it doesn’t work as well anymore. & NOBODY IS ABOVE AN ADDICTION. Pharmacists , nurses , teachers , police officers, anyone can get addicted and the sad thing is most of the time it’s because a doctors too lazy to solve the real problem so he just numbs it. I’m not saying he’s not a good doctor but he did over prescribe and I’m sure he made tons of money doing it. A doctor is trained to pick out an addict if you see one don’t prescribe them more medication. If someone who you knew was a theif wanted to stay at your house would you let them? No, you’d be worried they might still from you. If you knew someone was an alcoholic would you offer them a shot? No, because you wouldn’t want to enable them. Everyone says he didn’t force these peolple to take pills. But if you were a doctor and a addict walked in would you give them more dope? No! And about addicts being having good tactics to get these pills how many times have you been somewhere and you said that person looks like he’s on drugs or that person is on drugs. If someone who isn’t trained can spot one out how could a doctor not?

  27. Patient of Dr David Smith on August 1st, 2011 12:15 am

    Common Sense Is Dead,

Unless I have sadly misunderstood the world around me, the DEA and various other agencies raid places ALL THE TIME that do not result in convictions, whether from acquittals or charges being dropped. Innocent people are arrested all the time. It looks like your common sense needs a little reviving.

And I would love to know how these people are able to just call and get their prescriptions called in for them because each time I see Dr Smith, he prescribes JUST ENOUGH of my medications to make it until the day of my next appointment. If for whatever reason, I “run out” (which has happened 3 different times when people thought they needed my meds more than I did and stole them), I haven’t even bothered to call the office because they will NOT call in any narcotics!!! You have to be seen by the doctor in order to get your prescription. The one and only exception to that was when my appointment was repeatedly rescheduled because of the meetings concerning Jay Hospital recently and then, they called in EXACTLY enough to make it until my appt if taken according to directions.

Now, I’ve been seeing this doctor for 30 years and have a long litany of legitimate and very well documented health issues that cause intense chronic pain. If I can’t get my meds called in without seeing him, HOW are your dope fiend (by your own definition) friends and family members getting it done?

I think you’ve been listening to some tall tales and not bothering to investigate the truth for yourself. Wow, and you implied that YOU had common sense! NOT!!!

Whaddaya know? I’m one of those everyone is talking so badly about and yet, I am able to use proper grammar, correct spelling AND write lucidly! Gee, I must just be the ONLY one who takes the medication the way it is prescribed. According to the naysayers here, I am the only person, out of the hundreds they see, who actually follows doctor’s orders. Interesting concept there: DO what the dr tells you and you won’t have a bunch of dope heads on your hands!

  28. Common Sense is Dead on July 31st, 2011 10:11 pm

I have heard so many people, including several of my own relatives, say that all they have to do is call David Smith’s office and they can get a prescription called in to the pharmacy. Over and over and over. No need to come in. No need to carry your lortab-high self in there, so the doc can see how spazzed out you are on drugs, or how you’re about to go crazy to get more.

    Just call it in.

My neighbor sold her meds that Dr. Smith gave her. She was definitely wacko when she didn’t have any to take, but at least she got some money in her pocket and the good doc could bill Medicare.

No matter how NICE Dr. Smith is, I believe he will be proven guilty of over-prescribing narcotics, over-billing medicare and medicaid and who knows what else.

He’s a pill pusher. Plain and simple. Do you dummies think the Feds and cops would just barge in there not knowing anything? Of course not. They’ve been watching him for years.

He’s got it coming. He’s got a lot of people hooked on drugs. You think that’s not his fault???? When he prescribes lortab to someone for years and years??? It’s all their fault? Not hardly. A doctor is supposed to HELP his patients. He’s helping some of his patients to an early grave. I know of several.

  29. Tina on July 31st, 2011 7:50 pm

Amazing, How quick to judge. God bless the Docs and their families first and foremost. Now to the idoits, if they were over prescribing, the DEA would have been in there long before now because narcotics are very closely monitored and the amount dispensed by a certain doctors. There have been several docs to have their license placed under suspension for over prescribbing or revoked. Check it out!
Now I hope the good docs and a few of their very sick patients get them a great lawyer and sue the heck out of the people who felt the need to contact the DA and make a formal complaint. They are not to blame for your weakness or addiction problems. You made the appoinment, you filled the meds, you, you, you!!!
Pain Management docs do the same thing. write monthly narcotics but for stronger meds then they were prescribbing. Plus pain management docs are to get into. They are not responsibile for people coming to their office and lying to get drugs. There is always a handful who mess it up for the people who truly need it. People who over dose have problems and everyone wants to point the finger. Ever heard of intervention. Do something to help before they overdose. but these doctors arent to blame. No more then Miller Brewing Company is to blame when someone gets drunks goes out and gets in a car, drives, has an accident and kills someone. Yes, its tragic and should not have happened and it breaks the heart of a bunch of people.
I hope it all works out.

I have been a patient of Dr.DAVID SMITH for 25 years and my 2 daughters has been seeing him for a very long time both of them r a seizure disorder patient. My heart goes out to the town of Jay and to both of these wonderful Doctors and their medical staff. But i know and god knows that Dr.David and his son Dr.Michael will bounce back and get their license back.Because they have not done anything wrong and the narcotics that they prescibe to their patients once the patient leaves their office and gets their meds filled these 2 doctors is not there holding a gun to their heads telling them to OD on their meds or forcing them down there throat. So its not their faults on what happens to the patients after they leave the office. And the Feds and law inforcement in the State of Florida the law is supposed to be innocent until proven gulity but its backwards u r gulity until proven innocent.Im sure that most all of their patients and the people of their town of Jay and the surrounding areas will stand behind these doctors 110% per cent also the Medical Staff and of Jay Hospital. So where does Dr.David and Dr.Michael Smith patients is supposed to do next? They have to suffer cause of stupid idoits that abuse their medications that were prescibed to them.So we r praying for u guys and everything will work its self out.MAY GOD BLESS U ALL.FEDS LEAVE THESE 2 DOCTORS ALONE AND GO OUT THERE ON THE STREETS AND ARREST THE REAL DRUG DEALERS AND GET THEM OFF THE STREETS.

Say what you want but the fact is ..it’s well known in the area that if you need a scrip for pain pills..go see Smith..he’ll give you whatever want if you say it hurts bad enough.. Writing a scrip is not caring for your patients..Finding the pain cause is.. he is a pill pushing country doctor and finally people will have to do without him hopefully..

The country is broke & going out of business in a few days, so the Feds decide to run a RAMBO RAID on a country doctor in Jay,FL (POP: 500) No wonder we are broke…So what if there are some illegal pill poppers – people in this area work at hard @ back-breaking, bone aching jobs in the peanut fields, cotton field, oil rigs, construction sites 12-14 hours a day in the heat & the cold….does it matter if they take a couple of pain tablets at night so their worn out bodies can rest…their bodies get hurt, worn out & sometimes broken…they don’t have the luxury of sitting behind a desk in their button up shirts & khaki pants pushing pencils…surely the FEDS have bigger fish to fry..I sure would like to know how much tax $$ were spent on that FIASCO…let freedom ring!!!!

To Sandy M: I did like the part in your link about causing doctors to “divest from pharmacies.” I’m hoping that means pharmaceutical companies. Blah to the rest of it. Something will replace the pills. There is always something new in the drug world which shows that the real problem is demand not supply.

We need a task force to study the why and develop a plan to deal with that. I believe it’s a mental health issue not a law enforcement issue. Drug abusers need psychologists, psychiatrists, and treatment centers, not law enforcement.

    But so it is…

If anyone really wants to know what happened in Jay this week. Look no further than our on government. I believe that both Dr. Smiths will be justified at the end. If you do not like what happened in the town of Jay.. Let your voices be heard below.

And to all the people who have lost loved ones I am truely sorry for your loss but hopefully good things like these kind of bills will reduce the number of people who have to endure these type of pointless deaths.

  38. blue on July 31st, 2011 8:35 am

And I think for these patients who have cancer and other deadly illness medical marijuana isn’t a bad thing it is impossible to overdose on it and it gives them an appetite for the ones on chemo so no I am not against it for those purposes.

  39. blue on July 31st, 2011 8:18 am

This pill mill bill was a good idea Florida has too many people who can get access to pills for nothing other than recreational use which is killing about 7 to 10 people in our state a day. There are regulations on firearms and other thing that kill people why not narcotics.

  40. Charlie Zale on July 31st, 2011 8:12 am

Governor Rick Scott says he is making a hard stance against prescription drug abuse. He is raiding these pill mills. Who is he to decide who needs medicine or not? Last I heard his experience was in business, particularly medicare fraud. He is not a doctor. He was elected as a republican, supported and loved by the tea party. Both parties preach less government. This act looks like big government, now taking over the medical field. We just thought the Democrats are bad. Rick Scott is the best thing that has happened to President Obama.

  41. blue on July 31st, 2011 7:45 am

Mr.Scott I work in law enforcement so I do my best for the people I try to protect. These agencies will have their own medical experts who will examinate what they are looking for .And like I said the small town mob mantality doesnt like people who speak out about what they think is right. What you want my name and address for me to be able to voice my opinion and subject me and my family to any backlash by angry people going through drug withdrawls no thank you.

  42. Bystander on July 30th, 2011 9:58 pm

They haven’t been charged or tried yet so how could they revoke their licenses? Dr. Murray who is on trial for Michael Jackson practiced for months until he was finally charged. Just a thought.

  43. Sally B. on July 30th, 2011 7:40 pm

I have seen Dr. Smith since I was a child. I am grown now and do not. However, my parents do. While I do not agree with the amount of meds he writes to them, and the type of meds, I know he is a good hearted doc just trying to help.
My concern is for his patients, a lot of them are older and cannot make the drive to another doctor. AND now they are truely addicted to pain meds. What will happen to my mom? I am thankful for the DEA and the FBI but last I checked they were not doctors, so they have no rights sticking their noses in patient care. PERIOD. I mean who would want Dr. Smith investigating the murder of a family member. Not me, he has not been trainned… Well in the same sense they need to get out of practicing med. If you have a concern a doc is writing too much pain meds here is an idea……. sit down and talk with the doctor. Neither of the Smiths are criminals here, this is the biggest waste of police involvement I have seen yet.

  44. Mike P on July 30th, 2011 6:31 pm

to GENE W. SCOTT: We live in a police state. People are afraid for good reason to give their full names. They fear their employers too. We don’t live in a society that values different opinions. That is sad and lessens the sacrifices our forefathers made.

I served in the infantry myself and I didn’t fight for freedom. I fought for crooked politicians and the interests of those they served. I did my best because I was innocent and naive at the time. It wasn’t until later that what I did and why I did it came back to haunt me. That whole fighting for freedom thing is tiresome nonsense.

I believe the government should stay out of peoples personal lives. If someone takes a drug as an adult that is their business. All of it should be available at the drugstore. All of it. If people need help I support help. Locking up mentally ill drug abusers, which is the majority of them, is a waste money and inhumane.

And no, I don’t use drugs. Never have, never intend to. I just believe in freedom. I’m liberal like that.

  45. Mayor Chapstick on July 30th, 2011 5:58 pm

    @Marie Duncan, RN (retired)
Yes, that what this is all about. Dr.s who think they are above the law.
And yes, it is the Patients responsibility to take the medication as it says. It is the Dr.s responsibility to make sure the patient needs these medications they are giving away. There is a reason Dr.s go to school, and take an oath.
There is no difference in a Dr. prescribing large amounts of narcotics to patients who do not need them, from a Dr. who uses an ice cream scoop to deliver a baby. Sure the baby was delivered and the patients back isn’t hurting… but at what cost.
When I go to the Dr., I go out of trust. I trust that the Dr. will do what is best for me. Not what is the easiest or most convenient method.
But maybe you are right, everyone should go to college for 8 years in the medical field before going to the E.R.

  46. Mayor Chapstick on July 30th, 2011 5:37 pm

    @GENE W. SCOTT
    Welcome to the internet.
Is there a reason you want everyone to use their real names? Are you going to find these people that do not believe the way you do and reticule them?
You talk about freedom and what service men and women fought for. Anonymity is one of those reason they fought and fight for us. Also it would be great if Florida would become a medical marijuana state. Think of how many people will not overdose.

    @James Smith
are you sure your name isn’t Glenn Beck?

  47. Marie Duncan, RN (retired) on July 30th, 2011 5:31 pm

I plan to call and make Dr. Smith my new primary physician, if he will have me. I have a feeling, he may have more appreciative patients than he can handle after all this nonsense. It is the patient’s responsibility to NOT abuse narcotics. The government tries to police EVERYTHING lately BUT THEMSELVES. I am SICK of legal government criminals, that are “above the law.” Who polices them? Please. Give me a break. Doc. I’ll go to court with you and testify about patients and pain medications………..for free.

Just saying that law suits are the reason that health care is so astronomical….The average person has a hard time affording to have their health taken care of because malpractice suits have driven the cost up through the roof. HIPPA is in place for a reason, but suing is NOT the answer.

I can’t understand how taking away their narcotic license is constitutional. The last time I checked, you were innocent until proven guilty. It seems in this case, both of these men are receiving punishment and a trial has not even begun. The patients, however will be punished more than anyone, because they will go into withdrawals or suffer in pain until they find another doctor, if they can afford the gas money to commute to Pensacola or Mobile to see the doctor. Then how hard will it be to find an accepting physician to treat you without their medical records, which have been taken by our wonderful government. I am sick to my stomach to be in this state. Maybe Alabama is a more constitutional state to live in. I love America, and it is time for the countrymen to take it back from the government who has stolen our rights from us!

  57. blue on July 30th, 2011 2:30 pm

Ya you see law suits all the time its always about the money so try it but do you really think the same government that can seize propeties, freeze bank accounts and monitor cell or home phone cant look at medical records in an investigation and unless you can prove they took you own personal records good luck.Just a way for people to try to make a quick buck on the tax payers dime with another law suit i pay enough in taxes so people can have medicade and medicare but I will never see it when I need it in the future.

Still it’s the law. They have a right to take the records. You’re on the internet. Read up on the laws and regulations, or just call a lawyer and ask them if you have a case.

    @Everyone
Don’t worry about the Dr.s. You will be able to find another one to sell.. I mean prescribe you more narcotics.
I’m sure he has done great things in the medical field. He has saved lives. He has treated the elderly and the children. He is also under investigation for his wrong doings. Just because he saved you, your mom, your dad, or even your long lost sister doesn’t mean he doesn’t have a record of prescribing narcotics to patients that just go in and say, “hey I need some pain killers”. He is under investigation for a reason, and it is a good reason if the FBI and DEA are involved. Lets all pray that IF he is convicted, he will do time instead of just a slap on the wrist.

OK PEOPLE STOP!!!!….I have brain surgery in 2004 and met Dr. David in the E. R. after falling and hitting the base of my scull on a cement step. At the time, I didn’t have a doctor, cause I had been released from the surgeon. He was concerned about me not having a doctor and told me to make an appt. the next day and I have been using him ever since….Since that, I have been thru numerous tests that proved I have pancreatitis, fibromyalgia, osteoporosis and lot of back problems inclucing osteoarthritis…I recently had a kidney stone and bladder infection…and who was there for me?????….Dr. David Smith…..I also have severe headaches with this (arnold chiari) which is why I had to have surgery…since surgery, my brain has dropped again…..I NEED Dr. David….he has been there, even last yr when I was suffering with a horrible headache for 43 weeks straight!!!…When he couldn’t so anything, he sent me to a neurosurgeon…I was in Jay hospital 14 times in 1 yr from severe dehydration and he had specialists coming in to try to treat me….finally he found some medication that controls this….I haven’t been in the hospital for the last 2 yrs…and THAT’S because of him and his experience in treating me….NOT the specialist…so, all of you that are talking about drug addicts, just remember that there are those of us who are just trying to raise our children and move on with LIFE….he has given me my life back and for that I will ALWAYS be grateful…..just remember that there ARE bad apples out there….SPEAKING OF WHICH, I was at his office when he turned an elderly lady away because she had reverted back to taking street drugs and he had drug tested her…those “drug addicts” you’re referring to probably take their medicine in less time that they should and he doesn’t know this…but, I GUARANTEE you that if he knew, they wouldn’t be getting any.thing from him!!!……I’m in if any of you wanna hire counsel and fight this for him…He is DEFINITELY worth fighting for…the rest of you and just crawl under a rock and stay there, cause you don’t know all the details…like someone said earlier, “innocent till proven guitly”….and all of you need to read your bible about “sticking by you brother!!!”. He is a godly man and it shows in the way he takes such good care of his “brothers and sisters!!!..God Bless Dr. David Smith and your family and staff during this time of trouble!! My prayers are with all of you!!!

My husband did try to talk to Dr. Smith about the amount of pain killers that I was taking. In fact he talked to him personally. You know what he said “She’s a very sick girl and this is the only way she will get better”. Even my husband knew that I was taking way too much medication and that Dr. Smith kept providing it. There was nothing he could do to stop it. Until I realized it myself. I didn’t have to go to multiple Dr’s to get my meds. He was enough. Hell thank God I didn’t go to multiple Dr’s because I probably would have wound up dead.

  72. Sandy on July 30th, 2011 9:48 am

Has anyone ever witnessed the absolute wonderful theatrics that some patients can display when wanting pain meds? It is amazing! I work in a hospital as a nurse. Some of you may know me and that’s fine. I see people everyday come in wanting pain meds. EVERY DAY!!! When our doctors do not prescribe certain meds., we have been cussed, had things thrown, seen patients take the instructions and prescriptions and throw them in the garbage. It is a HUGE problem! Then as if that wasn’t bad enough, they may be called on to complete an over-the-phone survey which is posted on a website that rates the hospital according to these surveys. Well, guess what, we get bad surveys, we don’t get reimbursement from medicaid or medicare! How’s that? Well the government says we need to be the best at making people happy not necessarily treating them appropriately. So we turn the other cheek when we get cussed at, then we get slapped again when they do the survey. HMMM! Guess we should have given them their pain meds, huh???

You know until we educate people and fix this government as well as it’ people, this will never end. Did anyone know that the USA dispenses more pain meds than any other country in the world? We have created a generation of wimps! People want pain meds for even the simplest of injuries or illnesses. God knows, I am first to understand when you have acute injury or illness, these meds are lifesavers and certainly very necessary. It also hurts those who have chronic pain and need these meds just to function. My heart cries out for this country and all these people who are dependent, but also for these doctors as well. I do not know what the circumstances were and won’t speculate or judge because I wasn’t there. Bottom line is guys, these people want their drugs, guess what, they will find them somewhere else. These aren’t the only 2 doctors around.

  73. Ashley on July 30th, 2011 9:47 am

    @ r.
Yea it will be interesting to see how it goes down. And you are right. I had a pharmacist in Century when I tried to fill my pain pills there tell me that he wouldn’t fill them because I was getting too much codiene. Pretty convenient though that the pharmacy in Jay had no problem with it ever. Now if a pharmacist who doesn’t know me can tell me that I am getting too much codeine how come my Dr. doesn’t know that? Dr. Smith knew exactly how much and how often I was taking pain killers. He just didn’t care. I never lied to him and told him I was taking less. Hell, I was in there every month getting new scripts going through 110 pills every ten days. It’d be a little hard not to notice if he took any kind of decent records. I was a money pit for him and he owned me. People can tell me all day “Don’t bash, don’t throw the first stone, you don’t know him.” He was my Dr. for six years. If he couldn’t see that I was hooked on the amount of painkillers he was giving me then he doesn’t deserve to be a Dr. PERIOD. That is why the feds are after him. I know I’m not the only one who sent letters to the district attorney about him and it has finally bitten him on the butt. Most of the time Dr. Smith was a loving caring Dr. but he was doing a bad thing giving people all of this medication without protecting them as well. I don’t want him to go to prison but I hope they keep his narcotics license and that he can never prescribe narcotics to anyone else ever again.

Please stop with the “burning” of 2 individuals involved in a very unfortunate situation. Have you ever seen anyone withdraw from Xanx? It is a very scary situation. There are times that a MD must prescribe drugs to prevent acute withdrawal from drugs. Who’s to say these doctors prescribed to the point of addiction? Perhaps they were addicted from multiple sources that they visited and they did in fact need the drugs to prevent withdrawal. That can be a life and death event. Drug rehab? They don’t accept you as a general rule unless you have insurance coverage. While you comment on this issue, include the other problems. What about the VA? I know a man that gets 160 Lortabs every month. What he doesn’t take he sells. People will visit multiple ERs throughout the panhandle to obtain their drugs. Visit 6 in one night and you could score at least 90 Lortabs. It IS a huge problem in our society. Jay residents, It is time for us to band together and take our safe community back instead of allowing this incident to be a blight on our community. Don’t turn you eyes away from questionable drug activity. Call the police and report suspcious activity. Hold the police accountable for illegal drug activity. Continue to inform your MD about your family members drug abuse. Let this situation be the stimulus to make positive changes in our community.

  77. r on July 30th, 2011 9:10 am

People wake up ! Dr Smith might be a good Dr and has done good, but a Dr has a duty to his profession and his patients to up hold a high standard. I work in a profession that you can tell by a person looks if they are taking the pain meds for PAIN or if they are hooked on them and this is from looking at them from behind a counter. So it is hard for me to believe a Dr who sits in a room with a person for any length of time can not tell the same thing. He just chose not to do the right thing and either refuse to write these rxs or refer theses patients to a pain management Dr. Sometimes money can be the root of all evil, just think these people are hooked on the meds the only way to get them is to go see a Dr, humm… looks like a office visit to me (around a 100.00 now). Does every one remember Dr Graves from Pace he is in jail now wonder were all of his patients went??? I think people in this sleeply little town will be surprised as this goes on to see just how good the old Dr is!!

  79. Nurse on July 30th, 2011 8:52 am

Just to throw this out there…everyone keeps talking about how these docs should’ve sent these people to pain management. Good luck since the Smiths’ see a large bulk of patients that are either un-insured or have Medicaid. Trying to find a pain management specialist that accepts these types of patients are very few and far between. Seriously, look up every pain management doctor in the area and call and ask if they accept Medicaid. 99% of them will tell you no, and the other 1% only take so many every month. I have spent hours on the phone trying to get patients in to someone like this for my job. And forget sending them to a neurologist for “chronic back pain”, because they will deny them and say they don’t treat that. So, for people who genuinely have problems with chronic pain, what are they supposed to do? Don’t punish the majority who take their prescriptions as prescribed because of a few people who abuse the caring ways of these two physicians.

  80. Blondie on July 30th, 2011 8:09 am

OKAY FOLKS…there have been some very MISLEADING posts regarding an individual patient’s rights under HIPPA, and this case. ALL PATIENTS WHOSE RECORDS HAVE BEEN TAKEN/TAMPERED WITH SHOULD SEEK COUNSEL! Need to talk class-action. There was a (misleading) link published here (http://www.aele.org/hipaa-info.html) and it was asserted that THIS gave them (the Feds) the right to your personal medical records. WRONG! This link is NOTHING MORE THAN LAW ENFORCEMENT’S interpretations of what they believe they can get away with under HIPPA! DO NOT BE FOOLED…talk to an attorney!

Well, my 2 cents for what it is worth is that everyone has got their demons & if all of you “concerned about the community” people were so upset by people abusing pills & addicted to them, why is there no effort for a local rehab center or even a NA meeting in the churches. BTW people cannot just be taken off these pills cold turkey; some of which may already be ill/elderly & at risk for seizures…especially (Alprazalom) Xanax needs to be medically supervized and titrated down in slow dosages or it could lead to death.

It will take time for any charges due to the amount of files and other factors but something will be coming down the line.A full government force doesnt show up for a fishing expedition sorry.

If it is just his license for Narcotics, i will still be a patient he is my doctor not my means for a pill. If i need something more he can refure me to pain management. Im standing by my Dr. Michael Smith. I think this is an unfortunate example of what MOST DR.’s do to take care of there patients because after all they become doctors to help people and no one with a heart wants to see someone hurting. IN ANY WAY.
when you have a kid on the football field or basketball court and they get hurt, this DR. comes off the bleachers to take care of him, not give you a card and say bring him to see me at my office. THIS IS A GOOD MAN. YOU MAY WANT TO KNOW SOMEONE BEFORE YOU BASH HIM. That is what hurts people.
I have seen both sides but the bottom line is Im standing behind him.

  84. blue on July 30th, 2011 7:32 am

All of the people talking about a law suit on the FBI and DEA need to read up on the law and understand the government can and will step in and have right to patient files for legal reasons in an investigation of a Doctor. So good luck finding a lawyer that will touch that case.

And, oh yeah, I DO travel to go to Dr Smith, but that’s because I moved from the tricity area but wished to continue seeing the dr I’ve been seeing for the last 30 years. I saw no need to try to find a new one and establish a relationship with him/her when I already have one with Dr Smith.

  86. TwoSides on July 30th, 2011 6:41 am

There are absolutely 2 sides to this man Dr. David Smith. He is a wonderful caring doctor but i also know there are many people in the tri city area who take advantage of the system and use 3 or 4 different physicians including dr. smith to continue their narcotic pill problems. The only problem i see is that these doctors should have saw the writing on the wall. It has been going on for years and i see a lot of pill heads traveling even further every month to get their fix.

And Jay Florida is a nice sleepy little Town with a bunch of God fearing, hard working folks.
And I know a few of them, several of them, that have a pain pill problem, and they know it, as well as there family.
But, they are not out drinking and smoking pot, go to church on Sunday, and work hard the rest of the week.
Well, the Doc gives them the pills, and he should no whats best, so they don”t have a problem if the Doc says they need them, do they? These hard working folks that are hooked will soon be in the paper buying pills from undercover Narcotics Deputys. They can”t help it. They are hooked, and can”t do without them.
    SAD!

  88. SHO-NUFF on July 30th, 2011 3:29 am

Pain Killers such as Lortab and Oxycodone can be a blessing for those in acute pain, as long as they are prescribed, and taken right. The above mentioned, along with N-SAID anti inflammatory drugs do have severe long term effects on your liver and intestines, reguardless of how they are taken. You have to weigh the benifits, over the long term effects of use.
I have back problems, have had 2 surgeries. First Surgeon gave me a script for Percocet. 2 a day as needed for pain for 2 weeks, so a total of 28 pills. Second Surgeon perscibed 4 to 6 a day for a month. 180 pills. Well, I did not take any of them. I took Alieve instead. Yes, I hurt like heck, and percs would of done better, but I was scared that i might get hooked on them. And I know so many friends that are.
After I had my surgery, I soon got phone calls from people I new well, and some I didn”t. Was asked what was prescribed for pain, and if I had “any extra” pills. I was shocked to say the least!
Some of these people take them for fun, others are hooked on them from pain management in the past.
And by the way, any controlled pain killer, like Lortab, Oxy, ect cannnot be refilled without a new perscription. It cannot be “Called In” by the Doctor to the Drug Store. You have to see the Doc for a written script every time it is refilled, so you can be evaluated of you progress and needs.
A friend with the DEA told me that pain killers are harder to get off of than Heroine.
I will stick to the Alieve and Tylonol, and do the best I can,

I just saw all this about the doctors. I won’t stone these doctors, they know what they done or they didn’t do. I am a wife to a wonderful man, that has alot of problems, naming one his back. He is now trying to get disability, and needs it bad. He has suffered with major pain for over 16 years. The dope heads make it hard for him to get what he needs at the doctor and also at the hospitals. I beleive if a person has prove of his sickness that should be enough to get the pain meds they need. Not the government telling the doctor what they can’t give them. I like them to walk a day in my husbands life to see how real the pain is. To see what pain can do to a good working man, a husband , and a father. Now he doesn’t go without pain. Lord help us!!!

Everyone keeps talking about doctors being blamed for overdoses. I’m not talking about an overdose I’m talking about an addiction. And if a doctor gives you pain pills(narcotics) in extreme excess over the course of years you are going to become hooked. I’m sorry but that is just a fact. You may not kill yourself but you will end up with a serious addiction that can only be helped medically. People who think that the FBI and DA just show up on your doorstep for no real reason other than stupid propaganda crap are delusional. I’m sorry but little ol Dr. Smith is not worth anyone’s time unless he really has screwed up and done something illegal. Sorry guys but the pill buying days are over. Guess you’ll just have to find them on the street cause the legal one’s in Jay just came off the market. My family went through hell when I had to detox from taking too many pills over the course of a year that Dr. Smith kept prescribing me. Even though it was enough to fell a horse. He never refered me to a neurologist or tried to find another solution other than pain pills. I wrote the DA over two years ago telling them my story and obviously other people have too. I’m glad justice will finally be served somewhere and he at least has had his narcotics license taken away.

My best friend was a pill popper for fun until he found smith and ended up getting huge amounts of drugs monthly from him. He took a turn for the worst and is doing time now. This has been going on for years and anyone who has a hand in the drug world there knows this is the place to go for pills.

I agree with unbelievable that there is no way that Dr.Smith can make Baptist Hopital sell or not sell Jay Hospital. He does not have that kind of power over Baptist Hospital. You can’t sell something you don’t own and you can’t stop someone from selling something that they own. More than likely Baptist Hospital probabaly never wanted to get rid of the hospital but they probably got wind of this investigation and wanted to cut their ties to Dr. Smith.

  100. Health Care Professional on July 29th, 2011 9:55 pm

My prayers have been answered!!!! I am a recovering addict who has turned their life around. I have helplessly sat by for many years now as Dr Smith and his son write narcotic prescriptions namely, Methadone, Lortab, Xanax and Adderall and slowly kill loved ones around me. Literally, KILL!!!! As a result from overdoses. These people had no more legitimate medical problems than myself! I called his office after a very dear friend of mine died as a result of an overdose for the combined narcotics dispensed by Dr David Smith, namely Methadone, Xanax and Lortab. Firstly, as a health care professional, Methadone and Xanax is a deadly combination. Why would he write these to a patient? This was a 33 yr old healthy male who complained of back pain. Ha! Who doesnt have a little back pain from time to time? Anyway, I informed the staff of my resentment and suggested they were partly responsible for the death of my dear friend, may he rest in peace. The staff told me my friend was to blame for abusing the drugs. This doctor Smith knew these drugs were a deadly combination, my friend had no health care training, he was not aware of the dangers. Im telling you as a recovering addict, over half of the pills for sale on the streets are a direct result of the prescriptions written from mainly Dr David Smith and I, along with many, can breathe a sigh of relief tonight and sleep a little better knowing noone else will be in danger of dying @ the hands of doctors who abuse their rights and unethically write the narctoc prescriptions to everyday healthy people who dont require them. I have had many people contact me saying “I’m gonna have to go get a job now”. As many people made their living by selling the hundreds and hundreds of pills Dr David Smith would write out for them every month. That makes me nauseaus. Thank you GOD for your intervention. This is a huge triumph for our wonderful law agencies and for many mothers, fathers, sons, daughters, grandchildren who could have lost a loved one to narcotic abuse. PRAISE GOD PRAISE GOD PRAISE GOD!!!!!!!!

  102. Sarah on July 29th, 2011 9:46 pm

I support our Jay doctors completely. Personally I am a patient of Dr. Michael Smith but have family and friends that see all of the doctors at Jay Medical. If this investigation is indeed about narcotic prescriptions and said overdoses, please put the blame where it belongs, on the person that swallowed the pills. Any prescription drug could result in death because of an overdose, not just a narcotic. I have severe back pain and take prescribed narcotics as the doctor prescribed. Common sense tells me to only take these powerful drugs as my doctor wrote in the prescription. If someone chooses to take a drug differently from the original directions, then they are accepting the responsiblity of the bad effects on their own self. The doctor is not responsible! I am also diabetic and severely obese. Should we start blaming innocent doctors for those conditions as well? I think not! No one controls what food I put in my mouth. Yes, my doctor tells me I need to loose weight, but it is not his fault that I over eat and remain obese!!! My prayers are with the docs and thier families as well as our community at this time. I will continue to be proud to live in Jay and be a patient of Dr. Michael.!

  103. Ashley on July 29th, 2011 9:42 pm

If someone can “manipulate” a Dr. into giving them 110 pain pills every ten days they need to get an oscar(speaking about my personal past relationship with Dr. Smith). I’m sorry but there is just no excuse for prescribing that amount of pain meds to anyone. No matter what kind of pain they are in. That’s why he’s under investigation. If the DA, and the FBI didn’t have some proof that he was overprescribing pain meds they would not have taken away his narcotics license. And I’m sorry people but you don’t have to have a college education to understand that(even though I have one). They wouldn’t have taken all of his patient’s files, the computer hardrives, not to mention his personal cell phone which wasn’t mentioned in this but was in the News Journal, if they didn’t have significant proof(not just a tip) that he was doing something very illegal. WAKE UP. He may have been a good Dr. to some but he was a drug dealer to others.

My family and I have been patients of Dr. C. David Smith for about a year or so now. We all think a lot of him. Although, he was our doctor, he always treated us like we were friends of the family. He was a caring shoulder to cry on, when my husband passed away in December. My daughter has asked him for Xanax for her nerves, and he told her no, that she didn’t need them. He turned my son down on narcotics because he said that he didn’t want to get my son hooked on anything like that. Therefore, I don’t think that he was just pushing pills, I believe that some of his patients may have manipulated him and therefore may have gotten more than they should have. Thank you Dr. Smith, We support you 100%…..

  107. Relieved on July 29th, 2011 9:08 pm

Yes our family members drove to that doctor. However people get addicted to prescription medication a large part of the time from a doctor not some thug on the street corner. If you weren’t an addict and don’t have a close relationship with an addict you could never understand and I hope you never do. I was a addict went to rehab and am now a recovering addict. Addiction is a serious disease that takes many people lives daily people who are addicted are not logically thinking. So of course they drove to the doctors office. All addicts don’t believe they are addicted. Everyone trusts their doctor and believes their doctor would do nothing to harm them. I wonder how much money these doctors made off of addicts and for anyone who wants to call them junkies or anything else your not above an addiction. It can happen to anyone. An addict can pick a dealer out from a mile away no wonder they all went to these 2 doctors. Not all doctors in Jay are doing this. And these ” junkies” need someone to help them not hand them more dope. And for all these people who use him for what you say is legitimate pain I hope you realize if you’ve been on these pain pills daily for more than about 2 months when your prescription runs out about 2 or 3 days later you will experience withdrawals. For people who weren’t addicts and are lucky to not have any addict in your family personally these can be severe people can die from Xanax withdrawals alone. So thanks to a doctor not determining the problem and fixing it or having to much pride to say I can’t help you let me send you elsewhere people who actually needed this for a short time are now going to suffer. And talking about taking the medicine the way it’s prescribed my brothers Xanax said three times daily theres no reason he should of been taking Xanax three times daily for years now. Some people should stop and think. Don’t put the blame all on the addicts you dont know what got them started on pills my brothers reason was post traumatic stress from being in the war he didn’t need that for a long period of time after a month an a half the doctor should of sent him to a therapist. But that would of meant he lost his money.

He has never given me anything that was’nt needed. I remember asking him about a narcotic called Methodone because someone told me how strong they are. Dr. Smith told me no, because he didn’t believe that I needed them. When I was severely obese, he helped me get gastric bypass surgery that saved my life. He not only treated me as my doctor, he also treated me like a person and not just a number. I don’t know what he has prescribed to other people but I know what I asked him for and he gave me a definite answer of NO! Thank you Dr. Smith for being a caring doctor, I hope that this is over with soon so that your name will be cleared. GOD BLESS YOU!

There’s about to be a lot of people going through DT’s.

Not to mention, all you people supporting the Dr. Do you know how many people have died because of overdoses because of the amount of drugs this Dr. has prescribed them?

I would not be surprised to hear him charged with the deaths of those people.

There is NO REASON a person should be getting pain meds like Loritabs for years and years. The Dr was their drug dealer.

  113. Mike P on July 29th, 2011 7:43 pm

I haven’t read all of the comments but the ones that are happy that the Dr. may go to prison should be ashamed of themselves.

If your loved one drove to the Dr.’s office, made an appt. was examined and requested a drug because they had a preference then how is it the Dr.’s fault by granting the request?

If your loved did all of that then they knew what they were doing. If they died it is their fault, not the Dr.’s. People need to take responsibility for themselves and stop trying to blame other people for their own mistakes.

Why is it that everyone wants everyone else to get locked up all the time? What is wrong with you that you are so hateful? Are you going to start demanding that managers at Hardee’s be locked up because your so fat from eating there all the time? How about all that soda causing diabetes? Need to lock up those soda dealers too, huh?

People make choices. People need to accept responsibility for those choices. People need to get over this evil expectation that the government should punish everyone for any perceived transgression.

  114. Relieved on July 29th, 2011 7:30 pm

I am glad this finally happened my brother would see Dr. Smith who would prescribe him Xanax and percocet when my brother did not need them. Other doctors wouldn’t give him anything yet Smith did. No the docto is not responsible for his addiction however when 5 other doctors stated he didn’t need them and this one doctor gives them to him monthly. My 70 something year old uncle is addicted to pain meds to the point he can’t leave his home because Smith is giving them to him monthly. Can anyone really say a 70 year old chooses to become addicted to pain pills? & this uncle has been on them for years for a legitimate back problem but if there was nothing Dr. Smith could do for him he should of sent him elsewhere to a pain management clinic. I’m sure he has done a lot of great things for people but he’s also played a part in ruining a lot of peoples lives. & for the people who LEGITIMATELY need pain medication any other doctor would give them to them. No doctor would make any person who’s really in pain suffer. Not every ache and pain needs a narcotic. I had a c-section and only had narcotic pain medication for 3 days and then Tylenol for the rest. Where do people believe pain medication comes from the pharmacy isn’t handing it out without a doctor and most drug users don’t run it on insurance so it’s not picked up. Think about it anyone prescribing to much pain medication to people who don’t need it is a drug dealer as well the only difference is he doesn’t have to go to the doctor to get his medication or buy it from someone who has already been to the doctor.

My name is Kathy Dozier Penton. I am disappointed at cowardly / nameless people on this site saying libelous things about the professional integrity of our doctors in Jay. My immediate family has been going to Jay Medical Center for medical care for a long time. The doctors are superior and they care about people. They order tests, they order lab work, and they spend time with you asking lots of questions. I and my family have never been given unnecessary medication (or any pain medication that I can recall.) Dr. D. Smith, Dr. M. Smith, Dr. Kelley, Ms. Cotton, and Dr. Stewart save lives daily. In addition, they contribute back to the community in many ways. There’s going to be a lot of people with foot in mouth disease after this is over. A lot of people on here in support of the Drs. Sure, they might have been helpful to so many, but that does not mean they were not crooked and did not over-prescribe.

I believe I DO have a legitimate lawsuit concerning the confiscation of my medical files. I am currently going through a disability appeals process and ALL of my records are at Jay Medical Center. By confiscating my medical records, these agencies have, in effect, tied my hands and caused my appeal to be denied. There is no way for me to plead my case without the appropriate medical documentation, all of which seems to have been taken by these agencies with no way to retrieve them for quite some time.

I do intend to seek legal counsel in this situation. This is not fair to me and it’s time and money consuming for both me and Social Security.

to all the people who are saying bad thing’s about dr.smith should be really ashamed of themselves to even act in this kind of manner.DR.smith is not a pill pusher.i have been going to him for almost three years now,and he’s never just prescribed me anything.i cannot believe the act’s of people that live in the jay community would even say mean and cruel thing’s about the medical clinic.he has people that have cancer, that are dying, and some that have serve aniexty due to issues that they cannot control.if you were only a patient you yourself would see that dr.smith does not abuse his write out’s of narcotic’s. i hope to god that he get’s cleared.dr,smith you and your family are in my prayer’s.

For the people who live in Jay like me you cant say pills were not being way overly prescribed I know too many people that get so many they either sell them or take so many that they are like the walking dead.I also have had a few close people too me die and I for one am glad something is finally being done about this problem here.

  123. MLW on July 29th, 2011 6:29 pm

Baptist Hospital may not have one thing to do with this, but stop and think if Dr Smith is doing what he is accused of, then Baptist has known it for a long time. why hadn’t they turned him in before now. They also knew that David would never go for the selling of the hospital, so it is possible they have had there ducks in row for awhile. If Dr Smith works for Baptist hospital and he does this at the emergency room, then thereis no way that Baptist didn’t know about it years ago. according to people on this forum he has been doing it for years. Good Luck Dr Smith, I believe in you and I hope and pray it is not true.

I am not ashamed to post my real name and say that: Though I have no way to know what all went on in this investigation, I find it hard to believe that the Dr. Smith I know is guilty of what he is accused of. I cannot believe he was knowingly involved in criminal activity. He sure was there one day when I needed him. He did not give me narcotics. He put me in an ambulance and sent me to WFH. Why is it so easy for people who do not need pain meds to get them on the street, but those who need them cannot always get them from from a doctor because of their fear of the government? It sure seems to me that things in this once free country are becoming upside down and backwards. I do not know why there are any good doctors OR nurses left in America, the way the government harasses them. They ruined the best job I ever had. I loved it. They made it impossible to function legally. What a shame. I still think well of Dr. Smith. “Guilty” by government standards does not always equal “guilty” by just standards any more. The enemy is the ones I used to look up to. Maybe ignorance IS sometimes bliss. God knows who the real enemy is.

  126. ER doc on July 29th, 2011 5:25 pm

Some problems are soft tissue in nature, and are not in bones….therefore not requiring xray. Most people come to the ER when they need relief and don’t know what else to do. It is a tough position to be in as a doctor responsible for someone who claims they are in excruciating pain. It is actually a catch-22 because the doctor has to choose to judge you as a patient, to decide if they “think” you are telling the truth and “deserve” to be treated….but most are compassionate and try to at least give a patient a degree of relief until they can be seen by a specialist, which MAY require a small # of pain pills to get the patient by until they can get an appointment.

    The joys of healthcare!

    To justmywords:
Your problem was so bad it required you to have surgery? Sounds like you needed some kind of relief and someone in the ER tried to help you as best they could, since they can’t operate on you.

  127. just my words on July 29th, 2011 5:10 pm

this investigation has been going on for some time,it wasn’t over night, there were undercovers getting drugs from doctor without the doctor actual checking them out///come on people if you ever went to the er you know what i’m talking about they had regulars there just to get their drugs, I have been there several times and for real reasons but the most they did was write out pain pills–no xrays not saying they are not good doctors just they were legal drug dealers. and no i did not get the pills filled but went to another doctor and had to have surgery.

Kudos to those who have enough integrity not to cast the first stone. Those who are quick to judge/gossip/assume have no place in the Jay “Community”…they don’t know how valuable it is to be a part of a real community. Very sad.

It is a beautiful thing that the majority of posts are supportive to the doctors and their families. Anyone reading this who has something positive to post should do so to encourage the families. They need it right now. “He that knoweth to do good and doeth it not, to him it is sin.”

It has been mentioned in previous posts that there are some pretty interesting coincidences in the series of events leading to this raid. (I don’t, and you probably don’t, believe in coincidences.) Coming from someone who is a healthcare worker, well aware of the malice some hospital administrative offices will have when they feel threatened or if someone stands in the way of their “plan”, destroying the lives of a few small town docs is small potatoes to them. FYI: Things this severe happen ALL the time to people who buck their (hospital or any other) system and get in the way of higher administrative plans.

To the doctors and their families: stay strong, keep your head up, and fight. It will all work out and it IS going to be ok and worth fighting for with all you’ve got. There are enough people that will stand by you to get through this. You will also learn who you can’t count on, but do not let them bring you down to where their sad existence hangs out all day everyday. Just treasure your real friends even moreso.

I have read comments on this article that says Dr. Smith is the best doctor in the world and some say he is the worst. Others say the Baptist is to blame. Others even blame Gov. Scott. Some have blamed the individual patients.
This whole situation may be tied to some kind of criminal investigation or some allegations against Dr. Smith. It may have nothing to do with Dr. Smith character. Why don’t we wait and see what is going on and then make judgements..

    Really people?
According to the post about “it’s Baptist Hospital”.. This has to be the quickest organization of a raid ever. Is Baptist Hospital that powerful? They tell the FBI, DEA, and Police Dept. to jump and they strap a rocket to their rear ends.
Really, It took a lot longer for the President to have investigations on the location of Bin Laden, before he was able to give the go ahead… But Baptist Hospital doesn’t like that Smith “stood up for the people”, so they (in a matter of a couple months) have these “Drs” raided with no evidence at all.

This is what I get from the stories on here.
Baptist tries to sell Jay under the radar…. Smith gets mad, uses his super powers of Charisma and Wealth to stop the evil doers….. He successfully stops them from selling….. Baptist then hears about Smith’s unbelievable powers of Charisma and Wealth… Baptist decides they will not be out done by Smith.. Baptist then calls on the League of Super Villains (FBI, DEA, PD) to form an alliance against Smith…. The League of Super Villains decide the best way to get rid of their nemesis is to build a time machine, travel years back, plant rumors that he will prescribe narcotics to just about anyone, travel back to the present and have him raided.

Think about it people. It takes a lot longer than you think to gather evidence for such an operation to occur. When all the investigations are over, we will know the truth… but then the followers will say. “Baptist planted the evidence” “it was a set up”

This has nothing to do with Baptist Hospital selling Jay Hospital.
This is something that has been under investigation for years.
It is about time, and I hope they get what they deserve in a court of law.
So I am going to sit back, relax and be glad that another drug dealer is off the streets.

  136. Local Nurse on July 29th, 2011 4:23 pm

Would make sense to me that if the DEA was doing an investigation, and they wanted to do a thorough check, they would ask the docs to surrender their narcs license until investigation completed. Better safe than sorry on the investigators part. This certainly is no conviction or admission of guilt by the doctors. They have plenty of work that they can do without a narcotics license. I’m glad they are still available to take care of the sick patients in their community. Until this is all wrapped up, there’s nothing wrong with letting other physicians handle the narcotics issues. Again, it makes sense.

  137. BG Jay on July 29th, 2011 3:26 pm

Like I said before, they may prescribe the medication……you have to have the want to , to live….you don’t take them all at one time…just saying…the pills are not the issue here…..there are other things troubling someones soul to overdose yourself….

  138. Christopher on July 29th, 2011 3:17 pm

It is sad when a corporation like Baptist will try and destroy a physician his son and the entire community of Jay all because he stood for what was RIGHT and led the charge to stop the sale of Jay Hospital. Lets face it that is what this is all about and nothing more. Dr. C. David Smith has been a wonderful Dr. for many years, won many awards from the same people that are investigating him now and most important he has saved MANY MANY lives. I will NEVER forget the time my grandfather had a heart attack, it was going to take an ambulance almost thirty minutes to get to our house which was less than a mile from the hospital. Dr. Smith and two nurses along with life saving equipment, got a pick up truck and came to our house. They loaded my grandfather on the back of a truck, all the time doing cpr and other life saving measures to him and drove him to the hospital. I am very proud to say that Dr.C. David Smith SAVED MY GRANDFATHERS LIFE. This is just one story of many thousands if not more of acts that Dr. Smith has done to help save and heal people in this area. Another example, Dr. Smith is always at the football games for Jay High School and if a player for EITHER SIDE is injured you can see Dr. Smith jumping from the stands and running onto the football field to help that player. Dr. C. David Smith has been my Dr. since I was born over 36 years ago, his son Dr. J.S. Michael Smith is my physician now for the fact I knew him from school. I LOVE AND RESPECT both of these great physicians and pray for them, their families and our entire community of Jay. Everyone should just think about what I said at the begining and it should not take you long to put two and two together that Baptist health care is behind this mockery of our GREAT PHYSICIANS and should let Baptist know we WILL NOT have OUR physicians destroyed because they lost money in a back room deal. Baptist DOES NOT care about Jay and I wonder if they ever did. To both Dr’s, prayers from me and everyone else in Jay are going up for you and this will only prove to everyone how WONDERFUL you are and how LOW Baptist is. GOD IS GREATER THAN ANY MAN and HIS WAY WILL PREVAIL.

  139. MC on July 29th, 2011 3:02 pm

It’s not the physician’s fault if his patient overdoses. Patients should read the label and follow instructions. People should take responsibility for their own actions. Stop blaming good doctors for trying to help their patients.

To Unbelievable: He had more to do with Baptsit not selling than you think.

  140. Julie H. W. on July 29th, 2011 2:44 pm

I am praying everyone comes out of this ok. Like some are saying wait until the WHOLE story is in before you judge someone. Because any kind of finger pointing at this time is just trying to stir up things that are best left alone and remember you are pointing 1 finger at them and 3 back at yourself. Saying stuff that is not true or heard from the third party removed 6 times back is not talking about what you know as facts. I will continue to see Dr. Smith and my son will continue to see Dr. Michael Smith. I know I will have to make some choices here in my life style but maybe it is worth it and this is a good thing disquised in wolfs clothing. Everything has a silver lining to it, some deeper then others but there still the same. I am praying for all of you at Jay Medical Center.

So please run your mouth elsewhere!! The blame shall fall where it belongs…do you think some of these angry families could have done this???? Did that thought every cross your mind? Probably not! So until you know the FACTS, stop making accusations that you CAN NOT back up!

  142. Joyce Penton Schnoor on July 29th, 2011 2:30 pm

Dr. David Smith is a leader and teacher in the medical field. I will forever be grateful to him for saving my dad, Jim Penton’s life when he turned blue and almost died from lack of oxygen in his blood. (Another doctor at the old clinic did not even check his blood – I personally admired Dr. Smith for telling the other doctor that he should have checked his blood–Daddy was rushed to the Emergency Room.) Note: The doctor I referenced at the old clinic has been gone for a long time.

Daddy was alert enough to choose to stay at Jay Hospital and not be taken by Life Flight to Pensacola. He had never flown before and said that he would take a chance and if he died, he wanted to die at Jay.

A year later cancer (malignant melanoma) spread all over his body. After being referred to specialists at Baptist, he never asked for pain medicines from the doctors.. He was a tough old bird and farmer who knew how to manage his pain until he was turned over to Hospice and died a week later.

Dr. Smith and Staff: We have the highest level of respect for you and hope this nightmare ends soon. Hang in there– you are the best!

I know that the son prescribes an unnessasary amount of xanex to someone very close to me, and I’m not in agreement with this. And his father prescribed narcotics to someon who is now dead due to an overdose.

  145. Atmore G on July 29th, 2011 1:51 pm

These doctors are certainly innocent until proven guilty, but I don’t think the DEA would force any physician to surrender his license to prescribe narcotics unless there was probable cause.. I fear that even if the doctors involved are cleared, at best it will probably take months for them to have their licenses reinstated.. This is a bad situation for the doctors as well as their patients.. My prayers are with everyone, and I pray this will be resolved quickly..

JUST one little thought, it has been said that Dr Smith wanted to save Jay Hospital just to keep his own job. As far as I can see, he would still have a job whether Jay hospital was there or not. In fact if he didn’t have to run to the hospital all the time he could have seen twice as many patients. I know there is plenty of other people that would have went to him, if you just didn’t have to wait so long. I never went to him that he didn’t take all the time I needed and always seem to care. I know nothing about the narcotics, he never offered them to me. Maybe I should be upset (JOKE)

There are enough pre-conceived notions here for sure. Before drawing conclusions about things why don’t you wait untill the facts are in. It’s all hear say at this point. The only real known fact here is that they are doing an investigation on the place and the people.
Before some of you try and jump on this statement exercise common sense. Would you want to be convicted of something that had not had all the facts presented. Or on the other hand would it be fair to go by what little we know at this point and let someone walk because the facts have not been presented? I think not.
Just saying give it a chance the system that is and see what comes out of this before convicting someone!
    Jim for common sense!

Like so many others, I have been a patient of Dr. Smith for a very long time. If I have an appointment, I take a book or some crochet to keep me busy because I know that I’ll be a long time waiting to see him. He has never prescribed medications to me without cause. I have severe arthritis in my back, artificial hips and conjestive heart disease. When I complained about my pain he suggested that I take the high strength Tylenol, but not in the full recommended doses. It does help but there’s nothing that will totally take the pain away. He helped me see that and has encouraged me to seek other avenues of getting relief. If I wanted strong drugs for my pain, I’m sure that like most of the population, I could find them on the street where they are being sold illegally. I will continue to see Dr.Smith if he is able because I regard him as a good doctor. If I didn’t think well of him, I wouldn’t sit for hours waiting to see him. God Bless him and his family. This will blow over and become a small bump in the road.

I can not believe that people are pointing fingers at Baptist Hospital. Any EDUCATED person would know that it takes longer than a few months for this type of raid to occur. To have this many agencies involved at both federal and state levels, take months and months, if not years, of investigating. If Baptist truly wanted to get rid of Jay Hospital, they would have done it….they did not need his approval! So unless you k now what you are talking about when you open your mouth, do us all a favor and keep it closed. You are ruining the reputation of Baptist by saying these things…..you guys don’t want anyone talking about the doctors without all the facts, do you??????
I know the doctors at Jay and I DO NOT believe anything that has happened (or not) was done intentionally. They are all good people. But they still have to be accountable if anything wrong was done. At the same time, the patients need to be held accountable for taking thier prescriptions correctly. It is a two street. This is very unfortuante for all involved!

Way to Go Tess. There are real people out there who need pain meds who live with it 24hrs a day and it gets harder to get because of everyone else “bad habits”. The government just keep making new laws instead of cracking down on the ones prescribing it for every little ache and when people don’t really need it. Get real people wait for the facts to come out then make judgements. There is more to the story than you know. And this did not happen over night or a few months they investigate this long and hard before they went in there.

Dr. D. Smith was my doctor my whole life until I had to change several years back due to him being so busy at the hospital also. He was always very caring and always remembered you when you visited, always asking about my other family members. He helps out in the local area with numerous events and involves hisself in the area even though he has a very busy life. I have also visited Dr. M. Smith and he is also a wonderful doctor. Currently my doctor is Dr. J. Kelley and he is one of the best doctors that I have ever visited. Not one of the doctors in the Jay Medical Center has ever prescribed me any pain killers. They are caring doctors that treat their patients and only prescribe them what they need not whatever they want. This is not a pill mill so I just pray everything turns out for the best.

This is a on going investigation into these doctors practice not some retaliation from Baptist. The FBI, DEA, FDLE and State’s Attorney General’s office does not just walk in without plenty of prior evidence. Think people this is more than you realize. This type of investigation takes a whole lot longer to plan than a few months. Sometimes it can take a year or more to get all the facts and evidence before they conduct this type of raid. Also they checked records from several other Pharmacies in town. Baptist realize this was going to happen and they were trying to get out before it happened. He was trying to save himself and his statues and income not the people of Jay when he went on his one man crusade to save the hospital. Believe it or not people these doctors are human beings they are not Gods they can and do make bad errors in judgements. Lets face it this country is no longer about caring for your fellow man, its about the all mighty DOLLAR and if i can get away with it to line my pockets. All maybe play god along the way.

  159. anitafaye on July 29th, 2011 8:51 am

it is just crazy to hear people say “the doctor doesn’t make them take it’. My doctor in Pensacola doesn’t give out pain medicine unless there is a definite need for it from x-rays or mri. And then it would be temporary. A lot of people just go get the scrips and then sell them. The doctor knows this, but doesn’t care. A lot of people become drug addicts because of doctors. Any doctor that writes a scrip for narcotics just because someone wants it with no evidence of severe pain needs to lose their license. It is the doctors fault because he is a drug dealer. Doesn’t it seem strange that a small town like Jay has a doctors office that is packed with people all day. Dr. Smith Im sure is a caring doctor to his patients but that give him the right to destroy lives

I do want Dr. David Smith and family to know that the Leroy and Mary that commented above was not us. Leroy and Mary Shell would never respond as they did. How can we sit in judgement when we know nothing of what is going on? How can we sit in judgement at all? Are you ready to stand at the throne of the Lord and be judged on what you have done on this earth for Him, Our Lord and Savior??? Dr.Smith and family, remember you just have to have faith as “small as a mustard seed”, keep that in mind as this situation will certainly test your faith. Dr. Smith, we lift you and your family up in prayer and continue to believe in you as the fine Christian man, Dr. that you are. Just remember the time and dedication this Dr. has given to each of you that use him as their Physician. You need not respond to my comments about spelling nor gramatical errors, nor any negative responses to my ideas presented here as I will not be back on this website to read them. Dr. David Smith is my doctor and as has been since he opened his practice in Jay. I see him about every 3-5 years. I see him or some of his family outside of his practice daily or atleast weekly, and I think highly of them all. However, I don’t think that the FBI, DEA, and FDLE are in the business of trying to help Baptist in their takeover or whatever. They don’t do this sort of thing to people who are simply accused of wrongdoing. They can’t take those sort of risks. Sometimes they spend years investigating well known drug dealers or even terrorists before they move in. This could be related to one patient, one death, or hundreds of addicts who see him monthly for narcotics prescriptions. Alot probably have jobs and insurance, and many are probably simply living off of us working folks. We all heard the story together right here, and we will all learn the reason(s) as well as the outcome together right here. May God bless all who are affected!!!

I do like the idea of investigating the METHADONE CLINIC in Hwy 29 in Cantonment. That big building just south of Advance Auto, with no sign out front, with the parking lot full of cars in the morning…that’s it.

I have been a patient of D. Smith’s since I was 15 years old. I moved away and had a minor stroke. The Doctors where I lived would not help me. They sent me home twice after having the stroke caused me to have seizures. I decided to move back home. In one office visit to Dr. Smith, I was scheduled testing. I had another stroke (not so minor) a week after seeing the dr. I was admitted into the hospital for 5 days (without insurance). Dr. Smith found issues that were causing my problems.

He treated my dad for years, my mother, my daughter and many others in my family. None of us are addicts. I also spend hours in his office waiting to see him. When you are a good doctor, it is worth the wait. He has never pushed any pills on my family members! He treats each case individually.

Many of the workers at Jay Medical Center are excellent, professional and courteous people. All of the doctors that I have seen from there, which include every one of them now I guess, have been absolutely great.

My prayers are with everyone that works there. Things will be settled and life will go on.

Bless em Lord!!! And by the way to those who have never experienced SEVERE menstrual cramps and/or back pain, oxycotton is prescribed to those kinds of patients. If you know not of the pain keep your pie hole closed!! Pain is judged on an individual basis…I personally CANNOT deal with pain where the next Joe may be able to.. that’s why when talking to a doctor they ask you to rate your pain. I’m not judging or condoning anything about this investigation but rather addressing the ignorance of others…God bless those involved!!

  166. Tes Hobbs on July 29th, 2011 1:41 am

Florida Governor Rick Scott made the comment that pain meds should only be given to terminally ill patients. He said everyone else needs to “tough it out.” Apparently he’s never suffered from chronic pain or he’d have compassion for those who suffer from chronic pain. People who have pain 24 hours a day, 7 days a week, for all of their lives need relief from that pain. It’s not an addiction. They don’t get high. They get just minor relief from that constant pain. Where do you all come up with the idea that anyone who takes pain pills is an addict? Get real. Osteoarthritis, lupus, rheumatoid arthritis, cancer, congestive heart disease, degenerative back disease, sciatica, neuropathy and many other diseases and ailments cause chronic pain. Those who have chronic pain should not be made to suffer just because some people choose to pill pop to get high. There are alcoholics out there. Do we need to once again make alcohol illegal just because some people abuse it? What about cigarettes? Should we make that illegal too? Hey, some people even abuse coffee, tea and even chocolate, so should those be illegal too? No one is forcing you all to take pills. At least for now we live in a free country and we all should have the right to receive the individual medical care needed, even if it includes pain medications.

  167. Tes Hobbs on July 29th, 2011 1:24 am

Doesn’t anyone pay attention to the new laws? Effective 7/1/11 a new law went into effect in Florida that regulates doctors who write prescriptions for pain medications. This law limits the number of patients that can be on pain meds and puts the doctors and patients on a state registry. A search warrant is no longer needed to seize doctors’ records or patients’ records. This is a very dangerous law which takes away our rights to medical privacy.

  168. SouthernBohemian on July 29th, 2011 1:21 am

This whole mess just has me sick to my stomach and sick to my heart. I have never met a more caring, conscientious doctor than Dr. David Smith. He literally saved my life ten years ago and has been treating me and my husband for longer than that. Yes, he does prescribe pain medications for me and without them I would not be able to live with the chronic debilitating pain from which I suffer. He does NOT over-prescribe them. He gives me just enough to help me get through my day without being in more pain than I can bear. People who don’t have to live with daily, constant pain from (as in my case) multiple physical problems have no way of understanding what a Godsend physicians like Dr. Smith are. I don’t doubt that there may be people who come to him (and other doctors) and are not truthful, or they exaggerate their condition just to get narcotics. Then when they get their prescription filled they abuse the medications and do not use them as they are prescribed. Those are the people who usually wind up in trouble health-wise. He cannot follow them around to make sure they take their meds as prescribed, he can only instruct them and trust that they are doing as the prescription directions say. The patient has to assume some responsibility for their own wellbeing and abusing prescription drugs is not the way to do it. I’ve been on pain-killers for years and I have never abused them or taken more than is prescribed. The fact is though, I believe there is much, much more to this story than is being presently told. Others have mentioned it and I think they may be right. It is the only explanation that makes any sense. I only hope and pray that the full truth comes out.

I have been a patient of Dr. David Smith’s for 25 years. He has never offered me pain medication of any kind. He has encouraged me to have blood work once every two years since diabetes runs in my family. He has written prescriptions for antibiotics when test show I have some type of infection which is rarely. Yes sometimes I wait 2-3 hours to see Dr. David Smith but that is because he may be going to the emergency room or hospital because a patient of his has requested to see him and because he cares that much for his patients. Or it maybe because he cares for his patients and he spends time listening to his patients and trying to help them instead of herding them out like cattle. Dr. David Smith knows his patients and he knows about their lives and guess what?? In this fast pace life we live, he CARES!

  176. BG Jay on July 28th, 2011 10:07 pm

  177. huh on July 28th, 2011 10:03 pm

Dr Smith is a great doctor, When someone comes in and complains of an issue the doctor can’t just call them a liar. If they say they have extreme back pain or something like that the doctor will prescribe meds.

Often they know drug addicts are coming in, but you don’t know if a person has legit pain or not, they can’t just deny people medicines based on personal opinion.

  178. Michael Peak on July 28th, 2011 9:43 pm

I want to say Dr. David Smith is a great man. He treated my grandfather for cancer years ago and between him and the good lord he lasted another 8 years. I have always respected him and I personally think this is more of a power move by baptist then anything else. I have experienced baptist in pensacola and it was not pleasant. I think the people with the addiction problems need to seek help instead of blaming the doctor. Does he make you take them- no. Does he force them down your throat- no. Grow up people, this is political.

  179. Patient of Dr David Smith on July 28th, 2011 9:36 pm

I do also want to correct those who have said that Dr Smith doesn’t drug test his patients when they are prescribed narcotics. He tests me every 2 or 3 months to make sure that my levels are exactly what they should be. I’ve never had a problem.

Again, am I the only one who is concerned about my personal medical information being read by people who have no need to do so? I’ve discussed personal issues, marital problems, emotional ordeals and anything else I could think of with Dr Smith and I know it’s in my file. That’s not anybody else’s business! This type of thing will not help things at all. It will make people be less open with their dr for fear of something like this happening. It’s a shame.

  180. Patient of Dr David Smith on July 28th, 2011 9:29 pm

    Elizabeth,

My comments were correcting the mistakes made by someone using the name “Joleen”. The mistakes were NOT mine.

The correct word is SCRIP not script. A script is the written version of a play, television show, etc. A scrip is doctor speak that has spread to the streets which refers to a prescription for a medication (not to be confused with a subscription, which is an order for magazines, etc and commonly confused with prescription).

Reading comprehension seems to be a big problem here. I plainly stated that the first version in my previous post was by Joleen and that the second part was the one which was corrected.

    Pay attention, people.

I bet the people who work there could tell some stories, I use to work at a pain clinic and I knew the first day of the job I did not belong there and I started looking
fo a new job, I had a conscience, I would see people sit for hours and pay big money to just get that RX in their hand. I am sure these docs have done alot of good but if familes had asked them to please quit prescribing for their family
members and they chose to ignore them it doesn’t seem that they had the pt’s best interest at heart. For all the patients on here commenting did any of you ever take a drug test?? because most doctors who presribe narcotics month after
month follow their patients with drug testing. I bet alot of people are gonna be going through withdrawals soon because most docs in this area don’t give many narcotics, anxiety and sleeping pills.

there’s a lot of people who don’t know ‘proper’ doses…they trust the dr to prescribe it correctly…I’ve been there with my son, at 2 the dr gave him a max adult dose…we didn’t know until another dr caught it!
I have had antibiotics prescribed to me, and it was the pharmacist who caught it that it was too close related to one I was deathly allergic to!

there are some drs that will disreguard what you try to tell them and they just ‘blow it off’…saying it’s in your head. All drs need to learn to ‘listen’ to their patients and patients need to learn to talk to pharmacists when getting scripts filled to be sure they are right & the right dose.

I have had 2 encounters with the young dr Smith, once with my husband and once for me~not happy either time! I had been in a wreck…was brought in on a backboard by ambulance~ had severe headache, dizziness, nausea, kept blacking out, severe abdominal pain & bleeding, along with arm & hand pains…he ordered x-rays, said nothing broke, gave a script for lortab & muscle relaxers and sent me home…he never even actually came in the room with me or do any exam, just stood out in the walkway & wrote script for pills!
I ended up @Sacred Heart ER…had messed up discs, broke hand, torn rotator cuff, severe abdominal bruising, and bad concussion!

I am very against ‘pill drs’…they aren’t any better than street drug dealers!

If the dr is not guilty, then the records will show and they will be fine…if they are guilty, then the records will show it and they need to be busted & pay!

This is not a common occurence, there had to be enough evidence that something screwy was going on here, all these different departments don’t just show up at your front door without a reason. Ted Bundy was a nice acting person but he was a murderer. Alot of people who do good things also do things that are not right and just because they do good too doesn’t give them the right to break the law. I am sure if any of you had lost a family member you would feel alot different. Stay tuned I think alot of people are in for a rude awakening.

I am a RECOVERING ADDICT or JUNKIE, or whatever you want to call it. Clean and sober 3 years! I am also in the healthcare profession and work in a hospital in Pensacola. A doctor cannot be blamed for a person’s addiction. They do, however, hold some responsibility. If a doctor knows that a patient has a problem with medication, and they continue to recklessly prescribe it, they do need to be held accountable. Doctors take an oath when they become a doctor, and there is some responsibility that goes along with that. Blame them? NO! Hold them accountable? YES I have lived in this community all my life and know all of the docs at Jay Medical Center. I agree that Dr. Smith is a very caring doctor, and has helped many people. I have worked with him also, and he is one of the best teaching doctors I have ever known. This doesn’t mean that he’s never made a bad choice. Tes, I agree not every person who takes pain medication is an addict. There are many people out there who have chronic pain, and do need medication. But after reading the comments on here, I’ll take a leap of faith and say that there are many people whose lives have been affected by addiction. It’s a growing epidemic. Kids don’t have to go to the creek bank anymore to get a buzz…they just go to mom, dad, or grandma’s medicine cabinet. There has to be some responsibility by the doctors who are over prescribing. I hope the truth, whatever that is, is found. I pray for those involved in this. Anyone who is an addict or whose life is affected by an addict knows that it is a living hell. Doctors don’t shove pills down the throats of the people taking them, and the people taking them can’t go to the pharmacy WITHOUT a prescription and legally get them. This is not a black and white issue! There is alot of accountability to go around. I hope something good comes out this for everybody involved.

  192. DW on July 28th, 2011 8:42 pm

Thank god something is being done about this. My mom has been going to Dr. Smith for about 15 years. Throughout the years she has struggled with depression, back problems, heart problems everything you can think of. Shs is on about 15 different pills, from pain killers to anti depressants. She is not the same person she used to be, and this is b/c he prescribes her these pills every month when she goes for her “checkup”. All he does is pick up the pad & write her another prescription if she complains of something. She falls asleep sitting up, with cigarattes in her hand all b/c of all the pills shes strung out on. Family members have gone to him asking him to stop writing her all of these prescriptions b/c all she does is abuse them, but he wont. Why do you think ppl wait hours upon HOURS on their appts with him? B/c he will give you anything you want! My mom usually has her appts around lunchtime, will not get seen by him until after 6pm. I personally know if Ive waited for a dr for an hour,I’m not going to continue waiting, Im going to leave! But I guess if you want your pills that bad then you will wait…All I’m saying is I really hope he goes down…maybe my family can get back to the way it used to be….without prescription drugs!!

  195. out of town on July 28th, 2011 8:17 pm

Each person has their own experiences that cause them to judge what is going on in this case. For those of you who have never had an experience with addiction in your family and one of these dr’s was a contributing factor you have NO idea what happens. If you are not an addict and don’t ask for the pills, most of you are right, you are not going to get them. However my personal experience is completely different. BOTH Dr. Smith’s contributed whole heartedly to the addiction my husband has with paid medication. He would drive 2 hours from our home to get them to write him a “script” for whatever he wanted. I called Michael Smith and asked him to stop prescribing them because my husband was putting himself and others in danger when high. He decided not too and that was 6 years ago and he still prescribes them. This addiction has caused the demise of my marriage and the father/ provider my children needed. Let me say my husband never had a bad experience with one of these dr.’s. They always were very compasionate and understanding, they gave him EVERYTHING he wanted.

For the comment about insurance not paying. HELLO!?!?! The pharmacist will still fill it if you pay cash for it. You don’t HAVE to file it on insurance to get the medicine.

So for those of you who think that both of these dr’s are perfect, go ahead and listen to these comments because you will probably find later they are telling the truth.

I understand wanting to stand behind your “local hero doctor”. Both are big fish in a little pond. This is probably why this activity has gone on for so many years…..everyone has turned a blind eye…..small town……nobody wants this kind of thing to happen but the reality is, it does

There are known cocaine dealers and meth labs that don’t get the attention of SWAT teams and state and federal law enforcement! Get real! If you believe in political conspiracies, here’s one for you that has already been alluded to..it’s all about the money….Dr. Smith has been in business for many many years with nothing like these events ever happening at his clinic. Then he stands up for the citizens of Jay and Jay Hospital, and doesn’t fold to Baptist Hospital’s “plans.” A lot of money is potentially lost to Baptist Hospital and possibly SRMC. Suddently, law enforcement is entering Jay Medical Clinic with large guns and (as rumor has it) asking one of the doctors if he has a gun on him and actually searching him on the premesis–this after likely scaring the daylights out of anyone in the waiting room. If it’s possible for someone from Baptist or another stakeholder to pull strings to make a statement to Dr. Smith and the Jay Community, it has been done here….

  199. Empathic on July 28th, 2011 7:41 pm

I personally have been using the doctor of the Jay Medical center for years. I couldn’t think of any better doctor to visit when I am ill. As for statements made towards both Dr. Smith’s about “making” someone in your family an addict I only have one question: Did he force the pills down there throats? No one can “make” you become an addict and if you felt the drug or therapy prescribed was inappropriate, then I would suggest seeing another physician instead of consistently getting the same “poor” treatment. I can assure you that the patient did NOT just walk in the examination room and request pills and he immediately prescribed them, I mean think about it, what person would waste that many years in college for that. The physician ALWAYS examines the patient. If the physician does happen to agree with the “self diagnosis” of the patient after examination, then he prescribes what should be prescribed. It is a policy of the physician to ask if you have a preference to which drug is prescribed, they do take your opinion into consideration but they DO NOT just hand out pills to any one. Dr. Smith and son are good standing citizens of the Jay community and have always been present when the community is struggling, why turn your back on them at the slightest mistake? I for one will be praying for physicians and families involved. And to you so called “addicts” and your family members (who by the way, never said anything about you becoming addicted or asking you to stop or see another physician) this will be your opportunity to try another physician and quit taking pills if you believe you’re addicted. If you do continue to visit them and take what they prescribe…don’t complain about it being the physicians fault.

@Momless- Did you expect your 77 year old mother to live forever with a diagnosis of chronic COPD? The additional problems your mother experienced are “normal” complications associated with a COPD diagnosis. I’m sorry for your lose, but don’t blame a MD for her death. Sometimes, trying everything possible doesn’t and can’t change the outcome.

  203. Wow! on July 28th, 2011 6:50 pm

Wow! How about instead of playing the blame game, as most people seem to do, we take responsibility for what we CHOOSE to do. We do still have choices, don’t we? It is not the doctor’s fault if someone chooses to get hooked on these meds. If someone dies of overdose or whatever the case may be, it is NOT the doctor’s fault. People need to wake up and stop trying to blame everyone else…well if he wouldn’t have done that then this wouldn’t have happend, etc. Nowadays, doctors get put under the microscope because of these crackhead people that don’t know when to stop and people who actually NEED meds can’t get them or have a heck of time getting them. People make choices…DEAL WITH IT!

  204. Concerned Community Member on July 28th, 2011 6:50 pm

I would just like to say that Dr. Smith was my doctor for 20 something years until I got married and was forced to change doctors. He diagnosed my grandfather with Parkinsons and lung cancer, he has saved my daddy’s life three different times due to heart conditions, and has saved my mother’s life as well. Let me just add, that NONE, let me repeat, NONE of them have been prescribed pain killers just b/c they showed up to his doctor’s office! If people get pain meds, it’s b/c they have asked for them. Yes, there are stories of he should have done this or he should have done that….bottom line, that happens everywhere! I firmly believe that he would NEVER misdiagnose anyone on purpose! This kind of stuff happens everywhere. They only reason it makes the headlines is b/c we live in such a small community.
Everyone is entitled to their own opinions. That’s why we live in the good US of A, but people need to remember that there are families (innocent children) involved also. Everyone moans and groans about why small communities lack support. This is the perfect example. We have something going on at a local hospital, and everyone jumps to their own assumptions without having ALL the facts. Why would anyone be interested in coming to a place where people are so judgmental?

One more thing…This comment is addressed to JOLENE (7/28/11 @ 3:09) before you go picking on people about their spelling (when you know that people are upset)….maybe you should check your grammar skills…Your comment was and I quote: “Your just upset because your “candyman” might not be able to write your scripts… my advice…. loose the addiction and focus on learning how to spell?”

Honey, the correct usage of the word your is incorrect. It should have been the contraction you’re…for you are! If you’re going to go on a rampage and correct others, maybe you need to think twice!

  205. Sammie on July 28th, 2011 6:49 pm

I’m just laughing at the fact that everyone is correcting everyone’s grammar. However, nobody has mentioned how someone spelled “our” like I’WERE. @Glenda: I’m not being rude…I just want to know how you made such a small word so long? o.O

Not that it matters, after all, this is obviously a debate over who loves their doctor more. I thought the daytime soap operas were being booted off the air?

  206. Tes Hobbs on July 28th, 2011 6:30 pm

This is a sad state of affairs if people think that anyone who takes pain meds is a drug addict. Has anyone out there heard of chronic pain? It’s a real thing and only pain meds (yeah, prescription narcotics) will ease the pain. It’s not about getting “high” for a day or two, it’s about taking 2 or 3 pills a day, every day, to ease the pain so the person with chronic pain can continue to function. That means going to work, sleeping, living without that chronic pain, all with the help of a few prescription pills. Otherwise, it’s a life of intense pain, 24 hours per day, 7 days a week. Think of the worse pain you’ve ever experienced and then think of what it would be like to have that pain for every moment of the rest of your life. Pain meds are prescribed by doctors for patients who are in intense pain. Get over it.

  207. Time on July 28th, 2011 6:27 pm

As a fan of NorthEscambia.com for keeping us informed of news in the “North End”, I briefly read the article and perused the comments after arriving home from work this evening. I am not familiar with this facility, its doctors, etc. However, I find it interesting that over one hundred people have taken such an interest in this story to go online and rant with such energy and emotion. I only wish these same people could redirect their passion and support a charitable cause with this valuable time.

  208. My two cents on July 28th, 2011 6:20 pm

Everyone’s talking about pain meds, I see a pain management Dr. in P’cola that is real strict I have to pee in a cup and they test in in the office then to make sure I don’t have any illegal drugs in me and then ship it to a lab in Tx. to check the levels of the meds he has written me are in me. He also spends time with me asking questions and checking my mobility. I take these meds Not to get high but to releave my pain so I can try to live a productive life. My family Dr. could not write the scripts for what I needed for this so he sent me to my pain mgt Dr. There is a lot of doctors that wrte scripts for a lot of folks that don’t need them and they end up out in the streets it just makes it hard for the people that really need them !!!!!
Btw, my grammar was even bad in school many many years ago before I got hurt and had to start taking pain meds.

  209. Joe Singley on July 28th, 2011 6:09 pm

Really, why can’t people just wait and see what this is all about? Why does everyone think this is about it being a pain clinic? Why must people insist on pointing finger and accusing people of wrong doings, without knowing the whole story? Sweep your own door steps, first! I can imagine that we “all” got dirt on our step that we should be worring about.

This group of doctors played a big part in the death of my father and the addiction of my mother. I’ve seen way to many lives ruined by this type of practice. Medication was designed to help in the healing process and not as a means of escape from life. I’ve been in the medical field for twenty years and you cannot convince me that these physicians did not understand the ramifications of their actions. I feel a little justice for my family today!

    I am Faye Hudson
    from Jay;

The Jay Medical Center Doctors are professional, they care about people.
    You don’t find that everywhere.
I love Dr. Davied Smith and His son DR. Micheal I am mad abt these people
who are trying to destroy them because their families are dopes and can not
    manage their meds.
Dr.Davied Smith has been my Doctor since he started.
He help me as I struggle with Cancer when It look like I had no chance.
He took time to Talk and encourage me, he is not just a Doctor he is a Great Doctor and he’s my friend. He has tried to help your famlies with their problems did you try?
He has work endlessly to save our Hospital. I know you heard The Baptist statement. I belive someone saw a Comunity that would stand by their Doctor’s (DR.Smith’s) and had to fine another way to take over our Hospital.
Dr. Smith has dedicated his life to saving lives.
He and his son are Compassionate and and care about people.
Shame ,Shame on you that has tried to discredite them. Knowing they have stay
up many night helping some of your families.
He is a fine christian man and would never do anything knowingly to harm anyone.

I am Praying for God to stop this miscarriage of justic and for the
    staff of the Medical center.

We want to keep our hospital it could be your child life Dr. Smith saves.
Any Medical facility can not be blame for abuse a person does.

We have an excellent care facility in our community remember them in your prayers.

There are so few doctors that really care anymore we need good Doctor’s.
We are Bless to have good Doctor’s in Jay.

    God Bless
    Faye Hudson

  213. Voice of Reason on July 28th, 2011 5:41 pm

As a life-long resident of this community, I have experienced, first-hand, the compassionate care Dr. Smith has provided his patients at that small, rural outpost. This is a man who has committed his life to helping others; many of whom, by the way, are too ill, too poor or, in some cases, too ignorant to help themselves and all of which are members of our local community. He has spent countless hours by the bedsides of our friends, neighbors, and family members; sending many home healed and seeing that others are comforted in their final hours. He has seen after our sick children, our dying grandparents, our local indigent, and even, in some cases, you and I.

Let us not, in his hour of need, be too quick to pass judgement. Let us repay some of the ginuine care, concern and compassion that he has shown this community over the years. I, for one, will be praying for Dr. Smith and his famly that God will watch over and comfort them in this time of trial. As someone who tries to care about his community and his neighbors (and the people that care for them), I think that’s the least I can do. I hope and pray I am not alone in this sentiment.

Doctors write the prescription, insurance companies-medicad-medicare aprrove it, pharmacies fill it and patient takes it. Who is at fault? I’ve never been able to get a non-narcotic prescription refilled before my 30days are up. Insurance companies won’t approve it. All prescriptions are directed through the insurance companies and if they are using the same doctor or pharmacy or many doctors or pharmacies a red flag is thrown and the prescription should not be approved if they are asking for refills before their alloted time. It is ashame that many of these negative comments are from people that don’t know these doctors or staff. They have saved many lives and been their to comfort the ones and their families that they couldn’t save. I ask that if you don’t know these people please keep your comments in your communities. That is what’s wrong with the world today. Many strive on the pain and misfortune of others. We need to be more compassionate to the doctors, staff, and their families. Be supported if we can. If you can’t, then keep the hateful judgement opinions off this comment section. Voice it to your neighbor if you are not afraid to say it out loud. Remember they have kids and grandkids. Have compassion. Thank you.

Its about time some one looks into what i call malpractice

    To Panda Bear,

Thank you so much, I actually work in the medical field and I have been touched by this process in more than one way including some family members.
If you chose to prescribe large amounts of narcotics especially in a family practice setting, there are certain things you can do to keep tabs on your patients
like drug testing to make sure your patients are taking the right amount of meds or if they are not taking them at all and are selling them. Most patients don’t like to go to pain doctors because they are expensive and most require routine drug testing. I am sorry but everybody involved is responsible when it comes to narcotics including the doctor and the patient, if you have a habitual pain seeker
after a few months then apparently they have a deeper issue and need to be sent
to the appropriate specialist. Even really good doctors get caught up in the scenario, quick visits, good CASH flow, no Insurance to file, in and out. I even worked for one who got caught with his hands in the cookie jar, it is sad but it does happen. Like I said before if they haven’t done any wrong they have nothing to worry about but if they have they need to be stopped, alot of lives get ruined
    because of drugs.

  229. Bully on July 28th, 2011 4:33 pm

Drs. do not get raided for writing scripts no matter how bad we think they are. If that was the case, we would have a serious shortage of them. The the most common reason for these kind of raids are for medical fraud. Unnecessary script writing is a secondary cause due to fraud many times. The truth be known soon enough.

  230. tara on July 28th, 2011 4:32 pm

So relieved to hear that Dr Stewart will be seeing patients. My son has been sick and this has put a scare on us. We live an hour away so that should tell you we think she is a great doctor.
As for the other doctors, investigation will show if they did anything wrong. Hopefully it will be swift and not many will be put out too much while the investigation is going.
And I pray that Brewton Medical Center will be evaluated as well. The dr there has been giving my grandmother medication and she hasnt seen him in 3 and 1/2 years. Her feet are rottening (litterally) and she is combative when we try to help her and we talked to the dr and he refuses to quit just giving her meds.

If Jay loses Dr David Smith they may as well roll up the sidewalks….for you sanctimonious people there are legitimate reasons for pain medications & I hope you never have to suffer as much as my husband does…This could be a set up by by some one or some company but Dr. Smith is a highly intelligent doctor and he does everything by the book. He will prevail; I am certain.

    You wrote:

You do not need the possessive case of “you.” You are looking for the contraction “you’re.”

Two of the errors you cited are ones which are typically caused from typing too fast: “pary” and “pray” being a simple letter transposition. “I” and “e” are both struck with the same finger, but on opposite hands: another speed error. Spell check wouldn’t correct “boat.”

If this is about Pain Meds….

It is the DR’s Responsibility in prescribing medications to any patient. It is the Dr’s Responsibility to decide if the medication is needed. If someone gets pain meds for too long, the DR should be looking for alternate means to solve the pain over just giving meds.

If someone is on Pain Meds for too long, they should be referred out to a Pain Clinic/Doctor. Continuing Pain Meds without treatment is wrong and is definitely the Dr’s fault. A patient should only be able to get away for a short time lying to get meds as the doctor should recognize the issue and get them true help!

It is the Patients fault for the lying, but the DR’s fault if they do not diagnose it!

If you had any idea what Dr. Smith sacrificed in income and prestige to come HOME to Jay instead of taking one of the many very prestigious jobs he was offered all over the country . . . you are so a bunch of HATERS and backbiters and gossips. Yes, gale, he is RIGHT WITH GOD. But hateful and spiteful people will always find fault where they WANT TO. They will always fabricate something about someone. If you don’t believe me, think back to when you were a kid in elementary school. A bully could always find something about a kind, meek, selfless child to poke fun at if they tried. We are praying for you wholeheartedly, Dr. Smith. Don’t worry, there are a lot more people out there who love you but just don’t sit around all day glued to their computer waiting for some innocent person to HATE on. That’s like saying, its not the drug dealers fault you went to them to get drugs and they supplied them to you. They didn’t make you come to them, or make you take them. No drug dealer is forcing you to take any drugs. It’s up to you if you want to take them or not.

So it is the Dr.’s fault for giving a prescription to someone who is in no need of it in the first place. I’m not talking about the ones that go in and fool the Dr.s. I’m talking about the ones that go in and say “hey I got a headache and need some (insert drug of choice here).”

Fact is, if he did do that, he is among thousands of other doctors on a first name basis with their patients, whose problems they already know. A doctor’s time is very valuable and so are the patients he cares for, and we have a team of doctors in Jay that really care about our well-being, in and out of the office, as well as within the community. I know that he, nor his son, would ever hurt anyone. People hurt themselves. I could go to any doctor and fake an illness. It’s people who are addicted. People who want drugs, can get them. This has nothing to do With David or Michael. There is not one thing negative I could ever say about ANYONE in their family, they are all precious, loving people. They would do anything, for YOU, even the ones saying ugly things. I’ve known them WELL for over half my life, our families are very close, and my family stands beside them!

  255. Jane Hayes on July 28th, 2011 3:15 pm

@ Jay Parent- You are correct. My apologies for the error in spelling. Fingers got ahead of me.

Dr. Stewart will be seeing patients tomorrow. She and her staff are doing their best to contact patients at this time.

By the way, isn’t it funny that Baptist Hospital had to release a statement about the investigation not involving them??? HMMMM.. Just thinking out loud.

I bet that the person who said dr’s are passing out pain pills is mad because they wouldn’t give them any. Addicts do stuff like that. There chart gets flagged then cant no one write them prescriptions for pain meds.and they get mad and make up lies

  258. Mayor Chapstick on July 28th, 2011 3:14 pm

To CSG, No one said I filled the scripts. Everyone knows what is going on. We live in a small community. Word travels quickly. Especially when you have relatives who work in the hospital, and police department. Also, not sure what a druf is.

  259. joe on July 28th, 2011 3:10 pm

why is everyone speculating about what is going on? there is no reason to say anything as no one knows details of what is being done right now. coments are probably best left unsaid until more information is known.
no doctors or staff have been identified.

  260. Joleen on July 28th, 2011 3:09 pm

Ok….Now half of these people that have left comments on here are most likely high on the pills that Dr. Smith prescribed.. Ask me why???? So many of you can’t even spell the easiest of words like…. pray …and you spell it (pary), them (thim), and both (boat). Really!!!! Hit the spellcheck button people. Your just upset because your “candyman” might not be able to write your scripts… my advice…. loose the addiction and focus on learning how to spell?

I for one am greateful To Dr. Smith – He found my mothers (Dianne Salter’s) first turmor and referred her to one of the best doctors that specialize in her type of cancer. He has blessed me and my family thru a really hard time and shame on those who do not take their own medicine properly and as prescribed – which is not dr. smith’s fault.

  265. Patient of Dr David Smith on July 28th, 2011 2:38 pm

I have been a patient of David Smith’s for 30 years, when he was first opening his practice. He’s ordered a heck of a lot of tests through the years, sent me to specialists, etc.

As far as just giving you whatever pain meds you ask for, that’s a load of crap. I know plenty of people who go over there and get pain meds, yes, but the dr only has their word to go on. He has no way of knowing if they are in legitimate pain or not. I’ve never known anyone who just asked for something and got it. It took getting a final diagnosis of something that is known for causing intense pain to get him to give me anything stronger than Tylenol. I do take a lot of medications, but they are the same meds that would be prescribed to me by any other doctor if I were to go to them with my condition. I’ve never known anyone who just asked him for something…..and actually got it. I even recall when my husband pulled a muscle and he refused to prescribe anything other than a muscle relaxer because he said he didn’t want to get him started on narcotics.

There have been rumors for years about Dr Smith being investigated. I, for one, am praying that they don’t take my doctor away. I’ve been seeing him forever and I really don’t want to have to try to find another one and go through everything all over again to get myself back into remission. My health would definitely suffer.

Am I the only one who is outraged that there are a lot of strangers going through my medical files? It’s none of their business. There is very private stuff in there that I really don’t want anyone else reading. I discuss things with my dr because of the confidentiality protected by law that should NEVER be violated and I feel very strongly that this is a violation of that trust.

  266. Kathy Penton on July 28th, 2011 2:35 pm

I go to Jay Medical Center for my medical care. The doctors are professional and they care about people. They order tests and they order lab work. My doctor asks lots of questions. I have never been given unnecessary medication. Please remember these doctors are trying to save Jay Hospital. They save lives everyday. In addition, they contribute back to the community in many ways. Praying for God’s grace on the doctors, nurses, staff at the Medical center and at Jay Hospital and for all findings to turn out well. I hate this for the employees who may lose their jobs due to the greed of doctors
who learn that pushing pills is an easy buck to be made, the doctors have problems (GREED) and the patients have problems it’s called addiction. I hope they come on over to Milton (PACE) and get the one over here that is passing out pain pills like candy. I am sorry if any of you think a doctor is wonderful that hands out drugs like candy, because in the end it is Mothers, Fathers, children, brothers, sisters, wives and husbands that get to deal with the real problem the addict, how many of these doctors try to get them to stop or go to rehab, oh I forgot no money made doing that. God thank you for taking one or two down, please keep up the good work and take them all down.

  268. A Friend on July 28th, 2011 2:32 pm

I am very sad. Dr. David Smith (my doctor, my whole family’s doctor) is one of the kindest and hardest working people I have ever known. You have NO IDEA the number of hours in a day this man devotes to his practice, his patients, our hospital!!!! I do. My husband is one of his best friends. He always has time to listen to you talk about any of your ailments, and he always seems to be genuinely concerned. Any time any one of our family has a complaint, he tries to get to the heart of the matter and find out what’s REALLY wrong. Tests, blood tests, Xrays, etc. He supports our community in so many ways most people don’t even realize! He always looks at things from a perspective of if it will be beneficial to JAY. I too used to think that Dr. Smith just prescribed narcotics at will, UNTIL he became MY DOCTOR. This is a GREAT DOCTOR!!!! Did a better job caring for my children than a whole practice of pediatricians. We love you Dr. Smith. We are behind you 100%.

No wonder so many young people do not want to live here when they grow up… Your guilty until proven innocent, not matter how many people you may hurt, just you just keep the gossip flowing.. The truth will come out, then you can talk.

  270. mousewife on July 28th, 2011 2:24 pm

To all those fussing about getting pain medicine and the dr. not checking them out. Well the big question is..did u get the pain medicine filled at the pharmacy? If you didnt need it why take the prescription. Dr’s only know what we go in complaining about. And I’m sure if they are giving out pain meds then someone must be complaining of pain. Doctors may contribute to your addiction but they certainly did not make u one. People get addicted because they take the meds
My prayers are for all at the jay medical center

  273. PandaBearTrashCan on July 28th, 2011 1:26 pm

Surprised it took them this long. I’m sure they have a good reason to be there. All of those agencies don’t just show up because they want to. They do investigations, and get a warrant to search. What ever Dr. or Dr.s they are looking at, had it coming.

  274. Kathy on July 28th, 2011 1:22 pm

I think Dr. D. Smith is a very good doctor. People are saying he don’t do test they are wrong, he does test on me when I need them. I know I’ve seen plenty people getting test done also. He is a great Doctor so lay off his back. All people want to do is talk about something they don’t even know anything about it. I am praying for all of the doctors and everyone else. God bless you all !!!!!!!!

  276. Mayor Chapstick on July 28th, 2011 1:15 pm

About time. Anytime I go to Jay hospital and have to see Dr. Smith, he just walks in, gives me a script for pain killers and walks out. He has never even asked me questions as to why I was there. Even if he looked at the chart or records, he should at least take the time to ask the patient some questions. Pain Pills have become a great problem in the US.

  277. Victim on July 28th, 2011 1:12 pm

Concerning the comment about why a family member wouldn’t go to Dr. Smith and inform him that one of his patients is addicted and let him know what’s going on…I have a family member that is addicted to prescription drugs! That person’s been in and out of rehab NUMEROUS times…voluntarily an involuntarily! Many of my family members have been to see Dr. David Smith and explain what is going on and BEG that man to stop prescribing narcotics to this person and he WON’T!!!! Like the old saying goes, you can lead a horse to water, but you can’t make him drink…Well, if anyone knows anything about addiction, you know that it’s a sickness and disease and doctors prescribing these pills to these patients should be a crime!!!! You know, it’s like my old dog outside, he likes to eat cat poop, but does that man because he likes it, I should feed it to him? I think not!

  283. Rhonda on July 28th, 2011 1:01 pm

I won’t hide behind made up names. I or one of my family members sees one of each of the doctors in the clinic and I think it is terrible that people are ready to form a lynch mob without know whats going on. It amazes me that when a person goes to a doctor and lies about pain ( something a test cannot so) and the doctor helps by giving pain meds; its the doctors fault–not the persons. If a person is prescribed medication and does not take it as they are told to by the doctor and either OD or become addicted; its the doctors fault–not the person. These type of people are the reason that others with cronic pain and disabilities cannot get the pain meds they need. Doctors now have to be scared of the lynch mob mentality and people not taking responsibilty for their own actions.

  284. ThoughtfulCitizen on July 28th, 2011 12:58 pm

The physicians and staff at Jay Medical are compassionate individuals who truely practice patient centered medicine. They go above and beyond to serve their community and without them healthcare wouldn’t exist in this area. Before you wish ill on those who you know nothing about, consider the children and elderly folks in Jay and surrounding areas who rely on this clinic. Many of whom are alive today because of them.
As far as Dr. Stewart is concerned, she graduated from the University of Florida and was chief resident at Sacred Heart Hospital. She has saved the lives of many children, including my own and is a highly skilled, caring physician. The University of Florida doesn’t just pass out diplomas and the “written test” she passed, otherwise known as the National Board Exam, is extremely rigorous and you must demonstrate vast knowledge in order to pass it.
In closing, don’t throw stones if you live in a glass house. No matter what has happened, I know the care my family has received from Jay Medical. We are thankful to them and support them fully. God bless you all in this difficult time. The city of Jay stands behind you.

This is a waste of our tax money. Those Dr’s have always tried to
care and do what they could for us, (the family). However, all the Dr.
knows is what you tell them (or lie to them about).. Now, if you fall
weak or just a JUNKIE to the process, then that would be your fault.
Why blame the Dr. for being their to help you….As Always the rest must
suffer for the others WEAK mind……I think their is nothing to worry about,
because all the Dr’s really know is what is told to them by you guys (the patient)……So

Don’t blame everybody, but the ONE @ fault,– JUNKIES — Or the others
just looking for someone else to blame, As they said it’s SPECTULATION

Dr. Stewart is GREAT…..My child loves her……What’s ya’ll’s problem Again????

I do believe you should see what ever doctor fits your needs. Im just saying that Dr Stewart has done wonders for my son. We had already seen a few other doctors and was referred to Dr Stewart by a friend, she made sureto get us to specialists which have helped my son. She has always seen us and has always tried to do her best with my son. She has never given medicine out to us just to be doing so. If medicine was prescribed she explained it. She understood that I do not like giving my child a bunch of medicine and she worked with me on alternate avenues that didnt involve medicating my child. She taught me simple techniques to help my son remember, comprehend and deal with school work. She was very thorough with explaining things with me. These are just a few reasons why I use her. I do understand she may not be for everyone. As I say, to each his own. But for me, it would be devistating. Her entire staff is patient with my two children.

  287. proud family member on July 28th, 2011 12:48 pm

I have a family member who has been a patient of Dr. David Smiths for years. She has been fighting depression all of those years, we are talking 15 years. Through all of this he continues to tell her there is no cure so here take this. He has her on 3 different anti-depressants, 4 different pain meds, and 3 different sleeping pills. She is so doped up from the perscription meds he has given her she can’t function. When I made an appointment to speak with him about her he turned it around on me and said I was a bad loved one and that I should trust his treatment, he was trying to help her and I should stay out of it.

  288. the fact of the matter is on July 28th, 2011 12:42 pm

Lizard you are so right … they do only know what you tell them and how or what you are feeling.. and an addict knows just what to say and do…. I know they have started a new system there and other doctors and hospitals, so that hopefully your history will be available to these doctors and many will be caught on the lies and drug useage . My Thoughts and Prayers are with ALL the doctors nurses and the staff at Jay Medical.

  289. It's a Good Think! on July 28th, 2011 12:42 pm

I will not speak of Micheal Smith but I was once a patient of his father David Smith. After repeatedly going to him for headaches and trouble breathing, only for him to tell me it was anxiety, and for trouble with my foot, I’d had enough. He refused to check into my breathing problems or headaches brushing them off as anxiety and giving me a perscription for this, yet was quick to write me a perscribtion for muscle relaxers and pain meds for my foot. After finally going to a new doctor I learned that I have asthma and a neuromas in my foot that can be treated with a cortizone shot.

  290. Atmore G on July 28th, 2011 12:41 pm

I have used Dr. Smith ever since he has been a dr. I have tried other drs but most of the time I didn’t feelm like they were even listening to me. It just about always took three visits to get well. Dr Smith listens and does give great care. If someone got hooked on drugs it’s their fault not his. I’m really concerned about this. I have never personally been to this doctor but my sister has been to him multiple times for whatever reason she could think of. And he WILL give you whatever you ask for. EVERYBODY in Jay knows that! Thats why he is SO popular! People from Pensacola and all surrounding counties go there too when their respected doctors won’t dole out the requested drugs.
