Appeals Court Backs State On Prison Health Privatization
June 6, 2013
A unanimous three-judge appeals panel threw out a circuit court decision blocking privatization of inmate health-care services, a victory for the state in its long-running battle against unions to contract out more prison operations.
The ruling Wednesday would allow the state to push ahead with the rewarding of prison-health contracts to Corizon, Inc., in the central and northern areas of Florida.
The original ruling by Leon County Circuit Judge John Cooper had already cleared the state to move forward with a contract with Wexford Health Sources, Inc., for the region covering roughly the bottom third of the state.
Cooper ruled that the Legislative Budget Commission, a 14-member panel charged with overseeing spending amendments when lawmakers are not in session, went too far in approving the contracts for the other areas because that privatization was not specifically mentioned in the state budget. It was seen as a potential precedent-setting ruling on the power of the LBC.
But the 1st District Court of Appeal said Cooper was reading the budget too narrowly when he said that privatizing health services in the the central and northern regions was changing policy and was more than a limited tweak to the budget — both things the LBC isn’t allowed to do.
“On both requirements, the LBC has expertise as an entity composed exclusively of legislators that is charged with the inherently legislative function of appropriations,” Judge Stephanie Ray wrote for the DCA. “Given the LBC’s expertise and unique role within the Legislature, the LBC is entitled to deference in administering its budget-adjustment authority.”
Ray also wrote that a state law allowing the Department of Corrections to privatize some health-care services and provisions in previous budgets and the spending plan for the fiscal year that begins July 1 all suggested the Legislature wants to contract out the services.
“Outside the [budget], however, there is ample evidence, not only that the department was authorized to privatize inmate health services, but that the Legislature intends for such privatization to occur,” she wrote.
The LBC voted in September to approve an amendment to the current budget, which expires June 30, shifting money around to allow DOC to continue its privatization push. Opponents said the full Legislature would have to approve the decision to contract out the services.
The win for the state comes after other defeats on a push by Republican leaders and, at times, the Department of Corrections to privatize prison services and help reduce the state budget.
“We appreciate the ruling,” said Ann Howard, a spokeswoman for the department, in an email. “It will help save taxpayer money as we move forward, per the Legislature and now, the court.”
Alma Gonzalez, special counsel for AFSCME Council 79 — one of the unions that challenged the privatization — said that new language in the upcoming 2013-14 budget likely would have meant the lawsuit would become moot once the new spending plans kicks in, though she didn’t rule out an appeal.
She also said the state could have been spared the costs of a lawsuit if lawmakers had approved the prison privatization that way in the first place.
“The fact is that the citizens of the state of Florida, the taxpayers of the state of Florida have paid and paid and paid again to teach the governor to respect the Constitution,” Gonzalez said.

Scott Signs ‘Infants Born Alive Bill’ In Cantonment
June 6, 2013
Gov. Rick Scott was in Cantonment Wednesday afternoon to sign a bill that will seek to protect infants born alive after attempted abortions. Scott was joined by First Lady Ann Scott and pro-life supporters from across the state to sign the bill at Florida Baptist Children’s Home on Chemstrand Road.
The measure requires health-care professionals to “humanely exercise the same degree of professional skill, care and diligence to preserve the life and health of the infant” as would be the case in a natural birth. It also requires that infants born alive after attempted abortions be immediately taken to hospitals.
“As a father and grandfather, there is nothing more precious or special than welcoming a new child into this world and by signing this bill, we are protecting the most vulnerable among us and affirming their rights as individuals. This legislation ensures common-sense measures are taken to help care for the babies who survive abortion procedures and grants those infants the same rights as infants who are born naturally,” Scott said.
“On behalf of the Florida Baptist Children’s Homes, we applaud Governor Scott’s commitment to protecting the unborn. Our children are our most sacred treasures and it is imperative that all children- those born and unborn- are valued and treated fairly,” said Dr. Jerry Haag, president of Florida Baptist Children’s Home.
The measure received unanimous approval from both chambers of the Legislature.

Third Of Four Homicide Suspects Arrested
June 6, 2013
The third of four suspects involved in a December 2012 homicide has been arrested.
Deontrez Levon Kitt, 27, was taken into custody without incident around 2:30 p.m. Wednesday at a residence in the 5300 block of North Blue Angel Parkway. He was charged with capital murder on a grand jury indictment.
Meanwhile, police continue searching for Anthony L. Wilson Jr., 29, address unknown. He also is wanted on a grand jury indictment for capital murder.
Two other males – Deavis Saulsberry, 24, and Trevon Nelson, 28, both of Pensacola – have already been arrested and charged with capital murder for the December 24, 2012, kidnapping and murder of Torrance Hackworth, 32, of 1321 North J St., Pensacola. Around 2:45 a.m. on December 24, the suspects approached Hackworth when he arrived at his residence. They then forced him into the apartment, bound him with duct tape and held him in the apartment.
One of the males awakened Hackworth’s 36-year-old girlfriend and their four children, ranging in age from four to 10, and ordered them at gunpoint into the living room. As all six residents were held hostage, the suspects ransacked the house, demanded money and stole various items.
When Hackworth insisted he didn’t have any money because he had bought Christmas presents for the children, the suspects said they were going to kill him. The suspects then beat and struck Hackworth several times with a firearm in front of the woman and children before dragging him outside and putting him into the truck of the woman’s vehicle, which they used to flee the scene.
Approximately two to three hours after the abduction, the woman’s vehicle was found partially submerged at the Sanders Beach boat launch. Hackworth was shot several times and his body was found December 26 in a vacant lot in the 1600 block of North S Street. The incident is believed to have been drug related.
Agencies that assisted the Pensacola Police Department with the investigation were the Escambia County Sheriff’s Office, Gun Crime Response Team, Bureau of Alcohol, Tobacco and Firearms, and State Attorney’s Office.
Anyone having information on Wilson’s location is asked to contact the Pensacola Police Department at (850) 435- 1900.
Wahoos Drop Completion 4-2, Original Game Suspended
June 6, 2013
The Montgomery Biscuits wasted little time cashing in on their two baserunners once Tuesday’s suspended game was resumed at Riverwalk Stadium in Montgomery Wednesday night. The Biscuits held on for a 4-2 win. The Biscuits had runners at first and second with one our when Mark Thomas tripled to the left-centerfield gap giving a Biscuits a 3-2 lead. A batter later, Thomas scored on a sacrifice fly to make it a 4-2 Biscuits lead.
C.J. Riefenhauser slammed the door on the Wahoos in the ninth inning to preserve the lead. He earned his seventh save of the season. Wilkin De La Rosa (L, 1-3) took the loss for Pensacola. Both runners on base were his even though Brian Pearl took the mound when the game resumed. Merrill Kelly (W, 5-5) earned the win for Montgomery after allowing two runs over seven innings before the game was suspended on Tuesday.
Rain started to fall before the originally scheduled game was expected to start and it was eventually postponed. The Blue Wahoos and the Biscuits will now play a doubleheader beginning at 6:05 p.m. on Thursday night to wrap up the five-game series.
The Blue Wahoos are expected to send RHP Josh Smith (4-5, 3.79) to the mound in game one against LHP Enny Romero (4-1, 3.09). In game two Pensacola will go with RHP Shaun Ellis (1-1, 3.50) against the Biscuits RHP Victor Mateo (2-6, 6.35)
Following the game, the Blue Wahoos will head to Pearl, Miss. to open a five-game series with the Mississippi Braves.

Criminal Investigation Prompted By Commissioner’s Comments
June 5, 2013
Escambia County Sheriff David Morgan said Tuesday in a letter that he is directing his investigators to interview Escambia Commission Chairman Gene Valentino, and the Sheriff is asking Valentino to recuse himself from a Department of Justice Working Group.
Last week during an interview with WEAR 3, Valentino referenced “correctional officers playing video games on laptop computers and ignoring prisoners” and said “let’s address these issues before you come to me asking for money”. And the following day, he told two radio stations, including NewsRadio 1620, that the sheriff was holding a gun to the head of the county commission and that the commission will look for further efficiencies in the jail operations before agreeing to funding, according to the sheriff’s letter.
“For you or I to attempt to deflect our responsibilities by name calling, finger pointing and nitpicking managerial capabilities (or lack thereof) is an area I strongly encourage you not to venture into,” Morgan wrote in Tuesday’s letter to Valentino.
Morgan said he has opened a criminal investigation based upon Valentino’s “statements as a material witness” regarding correctional officers playing video games on laptops — a third degree felony offense. He said Valentino will be asked to speak to an investigator under oath.
The sheriff also asked Valentino to recuse himself from the Department of Justice Working Group. The group is working, with a deadline just over a month away, to address problems in a Department of Justice report on the Escambia County Jail that found prisoners’ rights were routinely violated, inadequate mental health services and other problems.
Valentino is currently on an economic trade trip to Panama.
Sacred Heart Health System Cutting Up To 150 Jobs
June 5, 2013
Changes are underway at Sacred Heart Health System that could cost between 125 and 150 people their jobs.
About three percent of the hospital’s 5,000 employees will be laid off from facilities in Pensacola, Miramar Beach and Port St. Joe. The layoffs are because the hospital is “facing daunting challenges because of a decline in revenues caused by government cuts in Medicare and Medicaid reimbursement” and a drop in admissions.
“To sustain our mission in the face of current trends, we must undertake a wide range of actions to reduce costs and restructure our system for the future,” Sacred Heart President and CEO Susan Davis said. “We are looking at all ways to reduce expenses and our plans include a reduction of supply costs and a reduction in the size of our workforce.”
