It’s loaded until confirmed otherwise. There are two types of firearm discharge, intentional or negligent. Since he did not intend to fire the weapon that makes it negligent.

Four rules you must know if you are handling a firearm:

1. Treat every firearm as if it was loaded.
2. Don’t point the firearm at anything you don’t intend to shoot.
3. Kee your finger off of the trigger until ready to fire.
4. Keep the safety on until ready to fire.

Good gravy people! If u dont know how to handle a firearm, dont get one. So glad the girls not seriously injured. This could be so much worse.
Now, please take a safety course and some lessons on how to properly use it.

That’s not an accident, it’s negligence…failure to follow the rules of firearm handling.
