In my opinion, the intent to kill is the deciding factor. 2nd degree murder is for a on-the-spot murder that was not planned in advance. 1st degree murder is for one that was pre-meditated and planned in advance. But murder is still murder and the intent to kill or not to kill is still a decision made by the accused. I think every investigated, verified, and lawfully convicted murderer should receive the death penalty. If criminals saw that being enforced, there might be fewer murders.

50 yrs not enough. My grandson got life without parole for attempted murder and he had no priors of any kind. 2

The fact he tried to lie about what happened is why his sentence is so high.
His anger for another person reached a point of him being out of control.
But saying self defense and or saying you blacked out is a outright LIE.
