Obviously this was a weak case! The violator had no legal right to refuse and blood should have been taken. With blood you would have a solid DUI case. As far as as the judge is concerned I’m sure he realized this was a weak case as well and accepted the State’s Plea deal!

According to the Florida Sentencing Guidelines he “scored 114 sentence points”. That works out to 64.5 months. He got 36 months. I follow this kind of stuff and you hardly ever see prosecutors let DUI w/injuries defendants plea down their minimum sentence. They usually ask for more time. Maybe this guy has friends in high places.

THAT STINKS!!! He deserves NO less than 10 years for DUI plus hit and run. Lackadaisical judges gives a rap on the knuckles and let’s them go with 3 years prison and 5 years probation!!! The judicial system is broken.
