It's not the police, they can only arrest them. It's the prosecutors who refuse to take charges to trial, offering sweetheart deals, and judges who keep giving them "another chance" Eventually, it's just cheaper to house them in prison than to keep paying for trials, costs of investigations, etc. It also saves innocent people as well.
