They must assume he will not commit any more violent acts before trial. There is the danger they may be wrong, but they have had lots of experience -- way more than we would like. Add the fact he has not been convicted yet and may never be. Keeping people in jail who have not been convicted is considered unjust....actually, it IS unjust, also illegal (8th Amendment in The Bill of Rights: "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."
