It is a plant containing a drug. Drugs do not become drugs or cease to be drugs based on legislation; legislation simply makes them legal or illegal drugs, controlled or uncontrolled drugs. Psychoactive drugs are drugs which affect the brain.

Careful. You’ll hurt his feelings, calling him a “peewee.” Pushers can be sensitive too — at least about their own feelings. When you fish, you catch what bites. And one way to go .after the “big boys” is to disrupt their supply lines. Even when they replace their retailers, the newbies are more apt to make mistakes.

You were talking to a different David, but regarding the Xanax, it is charged out as violation of “possess WITH INTENT TO SELL, manufacture, or deliver, a controlled substance” (893.13.1a2).

They ARE claiming it was intended for sale.

@Rasheed Jackson you must personally not like this guy to go off on the rant that you did over marijuana charges. Jesus. “Selling and distributing drugs is like shooting into an occupied dwelling or car…” that’s comical. Doing drugs is a choice, getting shot at unexpectedly in your home or car however is not. The guy is just trying to stay in business with all the medical marijuana places popping up everywhere. Do your research. Xanax is the only comeback you have and you who’s to say he was even selling that?
