I don’t smoke, vape, drink or use other drugs and am somewhat past the age in question, but:

“All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

14th Amendment

Equal privilege includes the right to do stupid things if other citizens are allowed to do them.

I think everyone in the military should be considered of age to do anything a 21 year old can do. can you imagine, a 20 year old that just came back from war who had killed the enemy in hand to hand combat being arrested for drinking or smoking, what a country we live in. an 18 year old can fight and kill or die but cannot have a beer?

They want to lower voting age to 16 but raise smoking age to 21…Ignorance abounds in politics…Kids can be drafted at 18 and sent to die on a battlefield but they can’t buy tobacco till 21….The endless stuidity astounds me.

So at 18 we trust them enough to put a fully automatic weapon in their hands, send them to the backside of the desert and trust them enough with who they kill and don’t kill, but, they can’t decide to chew or not? Stinking hypocrites!!
Next, they’ll be passing laws on how many times a week we can eat fried food. Because…the same medical journal says cholesterol kills you. I got news for you. We’re all going to die. Tobacco or no Tobacco

Society is always howling about the danger of tobacco, and it is a fact it is detrimental to your health. That being said, have you noticed not a single state in the union has banned or outlawed tobacco? Why not? Florida tobacco tax revenue for 2016-2017 was 1.07 billion, that kind of revenue loss is unthinkable to politicians. Any questions?

And yet, they want to lower the voting age to 16. Little Johnny and Suzy are too dumb to make decisions regarding their health or firearms but they want them to choose the president which affects us all. Because it “engages them in the Civic process”. Riiiight.

Never smoked nor any of the family smokes. That said see many problems with this.

Will violating this result in an “Arrest” who will Enforce it and by which Agency?
Is an Adjudication of Guilt required,Trial?
Will an “Offense” be on a person’s “Record” forever?
How will this effect a person’s employment potential?
What sort of “Punishment” will be given for under 21 possession?

While the public health benefits are positive there will be a tangle of legal troubles to make this work. Don’t support smoking, dipping or chewing from a health standpoint but just feel “the LAW” has more to do than try to bust a bunch of kids smoking out behind the cafeteria at school.
