Everyone: To get the death penalty he would have to be charged with 1st Degree Murder > To get charged with 1st degree murder the state would have to prove beyond a reasonable doubt that the murder was Premeditated. We have a justice system for a reason. It is not ideal that our taxes will have to pay for him; however, this is America!
