However Cuffy should be charged with child endangerment for not having the child secured safely in the vehicle, it is not the fault of any others for not securing your child properly. My 2 yr old gets his arms out of the straps all the time. Worries me sick that something might happen, my baby could get seriously hurt or killed & then someone will judge me. It could have been that the dad looked back & noticed he wasn't buckled & the accident happened before he could do anything. Seatbelts and car seats are there for a reason. Not just there for the fun of fighting with your child to sit correctly. The driver of the car that the kid was ejected from should be charged. Because of her ignorance to not follow the law, that child was ejected, and CRITICALLY injured. Hopefully they learn from their mistakes. So sad, prayers for the little boy. I hope he recovers.
