However, I do know that over charging defendants has become an epidemic. Playful wrestling got carried away, and a man is charged with a felony. The grandmother intervened and blocked the defendant from leaving the room. I totally understand a misdemeanor charge against the man where he escalated the playful wrestling by striking his wife with a clenched fist at or about the head, but when the man left the room he moved grandma and her walker out of the way. To charge him with a felony, where there is no other evidence of his striking the grandma is really a stretch. He should be charged with a misdemeanor, and the taxpayers should not foot the bill for him sitting in jail at 50k a year because somebody decided to turn this into a felony. He should be punished, but why do the folks who authorize these higher charges continue to punish taxpayers. Common sense has left the barn. I do not know all the facts.
