The way law enforcement can tell the difference is if your phone is in portrait mode and you’re pushing buttons your most likely making a call, if it is in landscape mode and pushing buttons it is texting. Most of the time that is there may be a few exceptions.

How does the law enforcement officer tell the difference between “texting” and dialing a phone number? The law is unenforceable now, and will remain so.

Here we go putting stiffer penalties on a law that’s not enforced. LEO’s don’t have the time to fight this kind of petty crap. You could make it an automatic two year revocation of your license and not make any difference in how many people text while driving because they just don’t care. Minorities more likely to get cited for seat belts a racial issue? Bah, maybe they should participate in the seat belt wearing phenomenon and they won’t get a ticket? Imagine that, obey the rules, act like a decent human being and you might be surprised how nice an officer is to you!
