In the case of the Walmart diaper thief i agree. But in the circumstance above the guy was waving a gun around. Now had the diaper theif done that i think the shooter would have a much stronger case. The shooter "assumed" the fellow "may have had a gun". Also hit was a young female who was in the car. How do you think this will come out. Stand your ground is not going to work.
