The statements meant to deflect intent were exactly that: only meant to deflect intent. It is the statements about NOT being serious which are the lies, and not the statements about what he wanted to do to the school. If you were the administrator of the school in question, which course would you reasonably choose: assume the kid was joking, or assume he was serious? The appeals court can only consider the legal argument, not the content of the threat - that has already been decided. It's ridiculous, really...
