Whether or not a BB gun is a deadly weapon has been disputed by the Florida Supreme Court but they left it up to a jury to decide on a case by case basis. If the jury examines the gun and decides it qualifies, it IS a deadly weapon. If they are simply told what it might do, their finding is in dispute.

I have taken a multi-pump BB gun and shot through a steel one-gallon paint can filled with water, leaving an entry and an exit hole. That one would have easily penetrated a person and his heart. A deadly weapon doesn’t have to kill to be a deadly weapon, it can just do great damage. Shooting out an eye should easily qualify and I know at least one person who can testify they will do that.

Actually, any BB gun could be considered a deadly weapon because it could be used as a club to beat someone to death with. One thing which is not in doubt is that it was armed robbery because the robber simply has to indicate he was armed to convince the victim for it to be armed robbery, even if he wasn’t actually carrying any weapon.

Hey Matt, When someone sticks a gun in your face or at your belly are you going to be cool and ask “Is that a bb gun or a toy or is it the real deal?”as for your question is it a deadly weapon or firearm – I’m not going to take time to ask if it pointed at me — I am just going to comply and give them what they want. Obviously the State of Florida has designated the bb”GUN” a GUN so that is your answer YES it is.

Some people are just plain and simple idiots–but if he used the money for Court Costs or Cost of Supervision — it is doubtful if FL DOC or The Clerk of Court will return the money to the robbery victims. Guess the girlfriend will out and about having a good time while he is in prison. My guess is that no “friendly” judge will give him House Arrest or Probation for these crimes. That is presuming no ASA makes a sweetheart deal and drops the charges to MMDS. OF course this is all based on the presumption he is found guilty. Would not like to judge this misguided young man who made a poor decision.
