CONSIDERING:
"the Jeep rolled pinning his younger brother under the rollbar because he was not buckled in."

I wouldn't blame the roll bar in that instance. People not buckled in are frequently thrown out and run over. Sometimes just breaking the glass with their faces or heads is enough, sometimes they are stopped when they hit trees or concrete.

Buckled up, the vehicle and roll bar tend to protect the person.

That rollbar can pin you if you are not buckled in. A guy I was in the service with told me the horrible tale of how he and his brother were offroading and the Jeep rolled pinning his younger brother under the rollbar because he was not buckled in. His brother kept saying "Tell Mama Im all right".

Jeeps are dangerous. A few years back my son was traveling not far from this site when his jeep overturned, thru him out and as a result after getting passerbys to stop and carry him to hospital, he was airlifted out of state to another hospital and after about six months in and out of hospital he lost one finger but all the fingers were looking to be amputated. Thanks to the Good Lord, a wonderful surgeon at the hospital there saved all but one. Be careful on dirt roads if you have a jeep; I know they are fun to drive but they can be dangerous.

I had an older Jeep like that.(1978 CJ5) The transmission locked up going down the road, and I spun out of control. probably a similar mechanical problem. I don't think a 44 yo would be showing out.
