That is an interesting law not being able to charge someone in a case like this. Very interesting indeed.

The article said…the passenger was transported by ambulance…duh that leaves only one more..guess he was a PASSENGER too ? Come on now….he was barely standing at the rear of the truck for the camera….get real….look at the picture !!

REGARDING:

County Road 4A starts just north of West Highway 4, goes out past Backwoods Road, makes a hard left at the intersection of State Line Road, another fairly hard left at Highway 168, then goes back to Byrneville Crossroads.

If you took the right at State Line Road, it would go past the funeral home and do a hard right at the US 29 overpass, go past Food Giant and stop at the base of the overpass.

So, based on this, if someone had been struck and killed, no one would be charged because there was no witness?

If they won’t say who was driving, could they be charged with interfering or hindering an investigation?

So , let me get this straight. If I decide to get drunk and drive with a friend present and we have a wreck,as long as neither myself nor my friend knows who was driving no arrest can be made? Thats crazy. No wonder we have so many drunks driving around here.

In Florida, if a law enforcement officer suspects someone is the driver of a vehicle and suspects that they are under the influence, the alleged driver can’t be charged with DUI unless an independent witness sees the person behind the wheel. It does not matter how many times the suspected under the influence person *admits* to being the driver. The driver of the vehicle is then listed as “unknown”.
