Not at all, in your situation. I was actually refering to whitepunk on drugs’ comment on the other article. I made a mistake and posted my comments all in one rant. But, it sounds like he has already laid out his plans to ambush a would be intruder. If that situation ever does happen to him, the state attorney will have an open and shut case of premeditation. There is nothing wrong with having a plan to protect yourself and/or family. The point I am trying to make is if you are going to defend yourself, you had better make sure you are acting under the color of the law or you could be possibly be charged with a crime. Most likely you wouldn’t be. But you can’t predict how the S.A. offfice will react to a particular situation unless it is well within the guidelines of self defense or the castle doctrine. Just because someone enters your house is not enough. You have to have a reasonable and well founded fear that you and/or family are in imminent danger of great bodily harm and/or death also.
Scenaro: Someone is coming through your bedroom window. You do not see a weapon. You do not tell him that you are armed and for him to leave. You just shoot him on site. During the investigation, you find out that it is your neighbor that was drunk and didn’t realize he was at the wrong house. He just thought he had locked himself out of his house. No criminal intent. Just an honest mistake. That exact scenario has happened before. You probably would not be charged for shooting him, but you would have to live with that death for the rest of your life. I agree you should have a gun for home defense. But, you had better be ready to answer for your decision to use it, if you ever have to. Protect yourself and good luck.

AM, Those deputies would be happy to patrol your area more often, if they were not busy handling all of the other calls or had more deputies to help carry the load. Call your Sheriff and talk to him about his lying about putting more deputies in the Cantonment/Molino area. Crime has doubled in Cantonment over the past few years and they still have only two-three deputies on duty at a time up here. Getting more deputies up here is the only way we are going to see a more visible presence. To all of you who are wanting to shoot first and ask questions later, I’ll tell you this. You had better make sure you are within the law or you will be locked up for manslaughter or worse. It sounds to me like some of you will fall into the premeditated murder category. That carries the death penalty in this state. Good luck!

If you would like (or need) more patrols in your neighborhood, call the Sheriff’s Office @ 426-9630 and tell them that. Tell them the specific problem too (i.e. kids on skateboards at 4 to 6 pm, red car circling block with lights off, or whatever your specific concern is). If you know where the offender lives, or his or her name, tell them that too.
The Deputies are more than willing to address your concerns, but they need the information.
